issued. <br /> 9. 3?1 Changes or deviations from plans <br /> schedules and phasing may be made only t,.a i th <br /> the unanimous approval of the Planning Board. <br /> 9. 392 The Building Inspector may revoke a <br /> building permit issued under this by-1 .avi in case <br /> the builder or developer fails to conform to the <br /> plans and schedules as approved. <br /> 9. 4 Exception for Cluster Development . <br /> 9. 41 Purpose : To encourage the preservation of open <br /> space and promote the more efficient use of Land, and <br /> to protect .and promote the health , safety and general <br /> vielf•are of the inhabitants of the town . <br /> 9. 42 any provisions of Section 7 of this by-lave to the <br /> contrary notwithstanding, the Board of appeals may <br /> grant a Special Permit .approving a cluster development <br /> in a residential district for- a. tract of land 20 acres <br /> or more in vihich some or all of the lots do not <br /> conform to the lot area., frontage , set back , or yard <br /> requirements of Section 7 of this by-1 atxi, provided ' <br /> that the Board of Appeals make= a. finding that the <br /> pubic good wi11 be serried and further provided that <br /> the following criteria .are met : <br /> 1 . The proposed plan v)ill promote the purpose of <br /> this section . <br /> 2. The total number of lots for building purposes <br /> (-�O thin the tract shok,,jn on the plan shall be <br /> not more than the number of times that the <br /> total area of the tract , in square feet , <br /> exclusive of roads, is vjhol1y divisible by the <br /> minimum lot size , in square feet , normally <br /> required for the district in which the tract <br /> is located. <br /> 3. The lots for building purposes shall be <br /> grouped in a cluster or clusters, and within <br /> each cluster the lots shall be contiguous. <br /> 4 . Each lot shall have a minimum frontage of j <br /> seventy-five ( 75) feet on a public or <br /> private way except as provided for under <br /> footnote number 1 of Section 7. 4 . <br /> 5. The minimum lot i-eidth at the building line <br /> shall be not less than one hundred ( 100) feet . <br /> 6. Provision shall be made so that Open Land <br /> 9-12 <br />
