i <br /> rl <br /> TOWN OF MASHPEE <br /> BOARD OF APPEAR <br /> s <br /> DECISION <br /> Reg Petition of Jean P. Canning for a Variance <br /> A Petition was filed by Jean P. Canning of Falmouth, Massachusetts <br /> for a Variance under Section 4.1 of the Application of Regulations and Section <br /> 14.1 of the Enforcement and Penalties, for permission to erect multi-family <br /> structures, and an extension of use of property located on Route 28, south <br /> of rotary (Map 81, Parcel 3), Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws, Chapter 40A as amended by Chapter 808 of the Acts of 1975. <br /> Notice was given by publication by publishing in the Falmouth Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee on January 8, 1980, <br /> and January 18, 1980, a copy of which is attached hereto and made a part <br /> hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, January 23, 1980 at 8930 p.m. at .which time the following members <br /> of the Board of Appeals were present and acting throughout9 Michael Makunas, <br /> Chariman, Peter L. Langler, Robert J. Houle. <br /> Mr, Michael Dunning, representing the Petitioner, submitted <br /> memoranda to the Board indicating the intension and reasons for the request <br /> to erect garden apartments. A request was granted to the Petitioner to <br /> continue the hearing until February 6, 1980, at which time a copy of the <br /> original plan of 1973, and additional memoranda was submitted to the Board <br /> for their consideration. <br /> Upon motion duly made and seconded the Board voted unanimously to <br /> deny the request for a Variance as requested. <br />
