The Board did not find a hardship, and the case referred to as the <br /> "Indian Suit" namely) Mashpee Tribe v New Seabury st al, has been previously <br /> held not to be a hardship. Moreover this situation affected all the Real <br /> Estate in Mashpes, and not just this particular parcel. Having found that <br /> a hardship did not exist the Board did not consider the other statutory <br /> prerequisites for a Variance. <br /> MASHPEE BOARD OF APPEALS <br /> BYi <br /> Deny (note minority decision) Michael Makunas <br /> Deny Robe J.
