L_ <br /> 1 <br /> TOWN OF MASHM <br /> BOARD OF APPEALS <br /> DECISION <br /> Res Petition of Jean P. Canning for a Special Permit { <br /> A Petition was filed by Jean P. Canning of Falmouth, Massachusetts <br /> for a Special Permit under Section 6.3 of the Special Provisions, for permission <br /> to erect garden apartments, and attached dwellings on property located on <br /> Route 28 (Map 81, Parcel 3), Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General laws, Chapter 40A as amended by Chapter 808 of the Acts of 1975. <br /> Notice was given by publication by publishing in the Falmouth Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee on January 8, 1980, <br /> and January 18, 1980, a copy of which is attached hereto,and made a part <br /> hereof. <br /> A public hearing was held on the petition at the Mashpes Town Hall <br /> on Wednedday, January 23, 1980 at 8x45 p.m. at which time the following members <br /> of the Board of Appeals were present and acting throughout& Michael Makunas, <br /> Chairman, Peter L. langler, Robert J. Houle. <br /> Mr. Michael Dunning, representing the Petitioner, explained to the <br /> Board that the original plan had been endorsed by the Planning Board in <br /> February, 1973. After submitting memoranda for the Board's consideration, <br /> Mr. Dunning indicated the intension of the Petitioner to construct a multi- <br /> family development. <br /> On February 6, 1980, the hearing continued, at which time a <br /> preliminary plan of the proposed project was submitted, along with additional <br /> memoranda, and a copy of the origianl plan of 1973. <br /> Upon motion duly made and seconded the Board voted unanimously to <br /> deny the request for a Special Permit as requested. <br />
