BOARD OF APPEALS <br />• MINUTES <br />September 28, 1988 <br />At 7:30 P.M. on Wednesday, September 28, 1988, the Board of Appeals <br />held a meeting at the Mashpee Town Hall. Board members present and acting <br />throughout were William Hanrahan, Cheryl Hawver, Richard Halpern and Edward <br />Govoni. Mr. Douglas Boyd, Building Inspector, was in attendance. <br />Landmark Realty Trust, Dana Pierce Trustee —(Owner of Record: Edward <br />and Heleana Wasil) Upon remand by Barnstable Superior Court, Civil Action <br />Docket Number 45848, Dana Pierce, Trustee of Landmark Realty Trust, requests <br />a Special Permit under Section 6.3 and 9.2 of the Land Use Requirements <br />for permission to operate a 70 unit motel with amenities together with such <br />additional Special Permit or other relief as may be required to construct <br />and operate such amenities, which include restaurant and health club, as <br />shown on plans filed.with Board of Appeals, in a C-1 zoning district (election <br />per 4.8) on property located between Falmouth Road (Rt. 28) and Great Neck <br />Road, Southwest of Jobs Fishing Road, (Lots 7 & 12, Assessors Map 74), <br />Mashpee, MA. <br />Members sitting: W. Hanrahan, C. Hawver, R. Halpern <br />• Representing the petition were Attorney Michael Dunning, Architect <br />Walter Yaroush, Engineer Robert Raymond and John Taylor, Trustee of Landmark <br />Realty Trust. <br />. Plans were presented showing the motel with 70 suite -type rooms consisting <br />of a living room and a bedroom. Mr. Dunning explained that there would <br />be no cooking facilities or kitchenettes in the suites._ Plans include a <br />small restaurant and meeting room with a total capacity of 100 persons. <br />The parking area will provide parking for 167 cars and the motel will have <br />two swimming pools and a health club. Water service is being provided by <br />the Highwood Water Co. and sewerage will be on site. Mr. Dunning stated <br />that the owners have no intention of converting to time-sharing or condominium <br />ownership. <br />The petitioners have reviewed plans with the Design Review Committee <br />and the DPW. Mr. Hanrahan reported concern that the water usage might exceed <br />15,000 gallons daily and Mr. Raymond stated that their projections were <br />for 11,000 gallons daily. <br />Mr. Hanrahan motioned to grant the Special Permit subject to the following <br />conditions: <br />1. Landmark Realty Trust would have to comply with any restrictions <br />imposed by the Board of Health <br />2. No interval ownership, including quarter -sharing, would be permitted <br />• 3. The permit would contain the restriction that there could be no <br />conversion to condominium ownership without the approval of the <br />Board of Appeals <br />
