• BOARD OF APPEALS <br />MINUTES <br />October 12, 1988 <br />At 7:30 p.m. on Wednesday, October 12, 1988 the Board of Appeals <br />held a meeting at the Mashpee Town Hall. Board members present and acting <br />throughout were: William. Hanrahan, Michael Makunas, Cheryl Hawver and <br />alternatives Richard Halpern and Edward Govoni. Mr. Douglas Boyd, Building <br />Inspector, was in attendance. <br />SGFS Realty Trust (continued from September 28, 1988(owner of <br />record, Donald West)- Request a variance under Section 7.6 of the Land <br />Space Requirements to provide suitable access in an R-3 zoning district <br />on property located at 1075 Great Hay Road (Map 98 - Lot 7) Mashpee, MA. <br />Members sitting: W. Hanrahan, R. Halpern, E. Govoni <br />Attorney Kevin Kirraine was in attendance representing this <br />application. Attorney Kirraine reviewed the petition and added that the <br />practice has been to show discretion in issuing of permits and that the <br />Planning Board has, on occasion, waived the requirement for 20' roads. <br />• Mr. Hanrahan read a letter from Fire Chief Robert L. Ridgeway <br />dated October 14, 1988 stating his opposition to the variance . <br />Mr. Halpern reported that he had driven down the road twice, <br />once in a rain storm, and that he had no problem in reaching the property. <br />He stated that he thought a fire truck could get to the property. <br />Mr. Hanrahan questioned if denial of the petition could be <br />construed as a taking. Attorney Kirraine replied that a denial would <br />render the property virtually unusuable and he would not hesitate to <br />bring a case for a regulatory taking. <br />Mr. Hanrahan read an earlier memo from the Fire Department <br />dated September 28, 1988 stating that the Fire Department had access to <br />the lot. Town Planner Thomas Fudula said that the memo of September 28 <br />referred to the Fire Department's ability to control a brush fire on the <br />lot and not a house fire. He asked Board members to discuss the property <br />with the Fire Chief. <br />Mr. Hanrahan motioned that the petition be taken under advisement. <br />Mr. Halpern seconded, all agreed. <br />• <br />
