Board of Appeals - Minutes October 12, 1988 2. <br />• Isabel W. Baldauf - Requests a Variance under Section 7.4 of the <br />Land Space Requirements for permission to vary the side line setback in an <br />R-3 zoning district on property located at 21 Riv erside Road (Map 119 -Lot 87) <br />Mashpee, MA. <br />Isabel W. Baldauf - Requests a Special Permit under Section 5.1 of <br />the Zoning By-law for permission to change, intensify, extend or enlarge a <br />pre-existing structure located at 23 Riverside Road (Map 119 - Lot 86) <br />Mashpee, MA. <br />Members sitting: Michael Makunas, William Hanrahan and Edward Govoni <br />Mrs. Baldauf was in attendance representing these applications. <br />There were no abutters present. <br />Mrs. Baldauf presented certified plans.showing two adjoining lots <br />of approximately 25,000 sf each which she has owned for 12 years. She <br />explained that there are two cottages in disrepair on the property, one of <br />them on the lot line. She proposes to demolish the cottage on the lot <br />line and rebuild it further in on the lot and to remodel the remaining <br />cottage on the second lot. <br />Mr. Hanrahan questioned if the new cottage would be larger than <br />the existing structure and Mrs. Baldauf replied that the square footage <br />would be approximately the same. He reviewed the lot lines and asked if <br />• plans were consistent with the neighborhood. Mr. Boyd stated that they <br />were. <br />Mr. Makunas motioned to grant the Special Permit and the Variance <br />as requested and found that they would not be a detriment to the area nor <br />derogate from the intent of the by-laws. Mr. Hanrahan seconded. All agreed. <br />Edward Sarfaty - Requests a Variance under Section 7.4 of the <br />Land Space requirements for permission to vary the front set -back in an <br />R-3 zoning district on property located at Whipporwill Circle and <br />Chickadee Road (map 125 -Lot 176) Mashpee, MA. <br />Members sitting: W. Hanrahan, M. Makunas, C. Hawver <br />Mr. George Thorng of Arrow Engineering was in attendance representing <br />this petition. He presented plans showing the addition of a deck not <br />included on the original approved plans. He explained that due to the <br />geometry of the lot the placement of the house now required a Variance <br />in the front set back from 40' to 30'. <br />Mr. Boyd explained that Whipporwill Circle is an old 30' setback <br />zone and that the Variance is not necessary. Mr. Halpern stated that <br />the year when the lot was created controls the zoning. <br />Mr. Hanrahan recommended that Mr. Long withdraw the application <br />• and Mr. Long requested in writing to withdraw this application without <br />prejudice. <br />Mr. Hanrahan motioned to accept his request. Mr. Makunas seconded. <br />All agreed. <br />
