Board of Appeals - Minutes - October 12, 1988 <br />• George J. Silva - (owner of record Faiman-Silva Realty Trust) <br />Requests a Special Permit to build a medical office building under Section <br />6.3.D.2 of the Land Use Requirements on property located at Falmouth Rd., <br />Route 28 (Map 81, lot 28) Mashpee, Ma. <br />George J. Silva - (owner of record Faiman-Silva Realty Trust) <br />.requests a Variance under Section 7.4 of the Land Space Requirements for <br />permission to vary the minimum front yard parking set back requirement and <br />a Variance under Section 11.B.5.I.H Groundwater Protection District on <br />property located at Falmouth Road, Route 28 (Map 81, Lot 28) Mashpee, MA. <br />Members sitting: W. Hanrahan, M. Makunas, C. Hawver <br />Attorney Jeffrey Oppenheim was in attendance representing this <br />petition. Also present were Walter Yarosh, architect of the building, <br />David Sanicki, engineer and Attorney Winn Davis. <br />3 <br />Attorney Oppenheim presented plans showing the location of the <br />proposed medical center. The lot contains 1.34 acres and is zoned industrial. <br />He explained that the Special Permit is required to build a medical office <br />in and industrial zone and that variances are necessary to reduce the minimum. <br />front setback requirement from 100 feet to 75 feet and to exceed the 30% <br />lot coverage requirements. <br />• Mr. Yarosh described the building which will contain 11,500 sf <br />and has been approved by the Design Review Board. Mr. Yarosh said he had <br />received bids of $31,000 for paving and $42,000 for landscaping and understood <br />that bonds would be obtained as part of the conditions. He reported that <br />a sprinkler system will be installed and the drainage system will be upgraded. <br />Mr. Hanrahan asked from comments from the Board of Health and <br />Mr. George Costa, Clerk of the Board of Health said that the Board had no <br />objections. Mr. Hanrahan stated that a Special Permit would prohibit the <br />disposal of any medical waste on the site. Mr. Costa explained that the <br />disposal of medical waste was under the jurisdiction of the State Dept. <br />of Public Health and is enforced locally by the Board of Health. <br />Mr. Hanrahan said that the Board of Appeals would set the bond <br />amounts. Mr. Makunas requested Attorney Oppenheim to submit separate petition <br />forms for the Variances. <br />Mr. Hanrahan stated that the Board had received a letter from <br />Nathan S. Ellis, Water Superintendent, of the Mashpee Water District stating <br />that the District had no objections to the petitions. <br />Mr. Hanrahan motioned to grant the Special Permit and Variances <br />subject to landscape and paving bonds to be determined by the Board. <br />Mrs. Hawver seconded.
