Board of Appeals - Minutes - October 12, 1988 4. <br />• <br />Bradford Wheatley - Requests a Special Permit and a Variance <br />under Section 7.7 and Section 11.0 of the Zoning By-laws to construct a <br />dwelling in an R-3 zoning district on Tide Run Road (map 125 - Lot 253) <br />Mashpee, MA. <br />Members sitting: W. Hanrahan, R. Halpern, M. Makunas <br />Mr. Jack Brown and Mr. Jim Havoc of New Seabury Engineering were <br />in attendance representing this application. <br />Mr. Brown presented plans to the Board and said plans had been <br />filed in 1974 prior to the ACEC act. He explained, that the buildable land <br />would be reduced 50% if the owner were required to stay within the ACEC <br />and required setbacks. <br />Mr. Halpern stated that the petitioners would have to get Con- <br />servation Commission approval. Mr. Hanrahan said there was no evidence to <br />show the building would be a detriment. <br />Judy Richard, a concerned citizen of Mashpee, asked for an <br />explanation of the Zoning By-laws involved. Mr. Halpern reviewed the <br />provisions of Section 7.7 and'11.C. <br />Mr. Hanrahan motioned to grant the special permit and variances. <br />• Mr. Halpern seconded. All agreed. <br />Ellis and Phyllis Allen - Request a Special Permit under Section 5.1 <br />of the Zoning By-laws to relocate and enlarge a non -conforming structure in <br />an R-3 zoning district on property located at 6 Jehu Pond Road (map 121, <br />parcel 2) Mashpee, MA. <br />Members sitting: W. Hanrahan, R. Halpern, M. Makunas <br />Ellis and Phyllis Allen were in attendance representing this petition. <br />They presented plans of the lot and explained that lack of frontage made it a <br />non -conforming parcel. There are three houses on the lot, one of which the <br />petitioners would like to relocate and enlarge. <br />Mr. Hanrahan stated that the plans would be improving the situation <br />by moving one house away from the wetlands. <br />Mr. Makunas motioned to grant the Special Permit as requested. <br />Mr. Hanrahan seconded. All agreed. <br />Mr. Janedy - Arrow Engineering - (Discussion) <br />There was no representation present for discussion. <br />Edward Amesbury - (Advisement) <br />Mr. Halpern reported that Mr. Amesbury has removed 6' from the <br />structure. <br />Mr. Hanrahan motioned to grant a variance of 5'. Mr. Halpern seconded. <br />All agreed. <br />
