• BOARD OF SELECTMEN <br /> MINUTES - REGULAR SESSION <br /> MONDAY, APRIL 23 , 1990 <br /> PRESENT: Selectmen Gottlieb, Lawrence, Jacobson, Executive Secretary <br /> Kevin Harrington, Town Counsel Joseph Reardon <br /> GUESTS: Ernie Virgilio, Mr . & Mrs. Robert Brown <br /> The meeting convened at 7:00 p.m. <br /> APPOINTMENTS & HEARINGS <br /> 1 . MR. & MRS. ROBERT BROWN - CAR DAMAGE CLAIM - Mr. & Mrs. <br /> Brown attended relative to their request for reimbursement <br /> for damage incurred as a result of a pothole on Route 151 . <br /> Mr. Reardon stated that if a defect appears in the road and <br /> the Town is aware of it, they are liable for damage. If <br /> . notice is not made to the Town of the defect, then they are <br /> not liable. Mr. Virgilio stated that upon notice, the <br /> pothole was temporarily repaired within 45 minutes. <br /> Mr. Lawrence stated that he did not feel that the Town has <br /> a liability and that the Town did not act in a negligent <br /> manner in the upkeep of the road or in their response to <br /> the condition of the road. <br /> Mrs. Jacobson moved to deny the request for reimbursement, <br /> based on the fact that the Town was not negligent. Mr. <br /> Lawrence seconded the motion. Mr. Gottlieb was opposed. <br /> OLD BUSINESS <br /> LINE <br /> 1 . MEMORANDUM FROM ERNIE VIRGILIO RE: LINE PAINTING - The <br /> Board received a memorandum from Mr. Virgilio stating that <br /> in the bid quote for line painting, it appeared that <br /> Traffic Markings, Inc. was the low bidder. However, in the <br /> "exceptions to specifications" , Markings , Inc. became the <br /> low bidder. Mr. Virgilio recommended Traffic Markings, <br /> Inc. in error. <br /> Mr. Lawrence moved that the line painting contract be <br /> awarded to Markings, Inc. as recommended by Mr. Virgilio. <br /> Mrs. Jacobson seconded the motion and Mr. Gottlieb was in <br /> favor. <br />
