c <br />Page 7 <br />Article 25 (continued) <br />January 16, 1974 <br />In addition, the developer shall submit such other detailed plans, <br />specifications and data as may be required by the Board of Appeals in order for the <br />Board of Appeals to determine whether or not there will be compliance by the developer <br />with the standards and regulations of this Section 9.5 so as to allow use of the land <br />as a Planned Retirement Community. <br />92583 The Board of Appeals shall render a decision within sixty (60) days <br />of the date of hearing. <br />9.584 The Board of Appeals may, in approving a PRC, impose such terms <br />and conditions as the Board of Appeals shall deem necessary to accomplish the <br />reasonable application of the standards provided in this Section 9.5. <br />9.585 Upon the allowance of a PRC by the Board of Appeals under this <br />Section 9.5: <br />A. The developer may develop the site in sections, and at or after <br />submission to the Board of Appeals for the approval of the Master Site Development <br />Plan, the developer shall submit to the Planning Board for approval Final Site <br />Development Plan(s) for the section (s) which it intends to develop. In connection <br />with each Final Site Development Plan, there shall be submitted to' and approved by <br />the Planning Board the plans and information required by Section 9.3824. Certificate(s) <br />of occupancy may be withheld until the construction as required in each section under <br />Section 9.3824 and other parts of Section 9.5, where said Sections are applicable, has <br />been completed "* or provided for. <br />B. The Final Site Development Plans(s) shall be approved by the Planning <br />Board if in general conformity to the Master Site Development Plan, patterns and <br />uses as theretofore approved by the Board of Appeals and in conformity to the applicable <br />rules and regulations of the Planning Board. <br />C. Each Final Site Development Plan shall show by metes and bounds the entire <br />perimeter of the section of the PRC then proposed to be developed, and all buildings <br />to be erected in said section of the PRC, together with the types of buildings to be ' <br />erected therein with an identification key. <br />9.586 Where the developer proposes to develop a PRC pursuant to a subdivision <br />as to which approval of the Planning Board is required under the Subdivision Control. <br />Law, the developer shall comply with Section 9.38 of this By -Law in lieu of Section <br />9.585. <br />9.587 Approval of the Board of Appeals for use of land as a Planned <br />Retirement Community under this Section 9.5 shall become void if the developer has <br />not applied for a building permit with respect to a section of the land shown on the <br />Master Site Development Plan within three (3) years from the date of such approval. <br />Construction of the first section shall commence within one (1) year after all local, <br />state and federal governmental permits and approvals with respect to the PRC have <br />been obtained; provided, that there shall be excluded in computing said one (1) year <br />period any period during which the granting of any such permit or approval is being <br />appealed or otherwise contested. In the event construction of the PRC has not been <br />substantially completed ten (10) years from the date that all such permits and <br />approvals have been obtained, computed as set forth above, then the developer shall <br />reapply for approval for the remaining undeveloped areas under this Section 9.5. <br />9.59 Miscellaneous <br />9.591 The Building Inspector may revoke a building permit issued under <br />this By -Law in case the builder or developer fails to conform to the plans and , <br />schedules as approved. <br />9.592 If any provisions of this Section 9.5 shall be found to conflict <br />with any other provision of this By -Law, such conflict shall be resolved in favor <br />of this Section 9.5. <br />• "and approved by" was inserted. <br />,.
