To see if the Town will vote to raise and appropriate or <br />transfer from available funds the sum of $125.00 for Mashpee's share of the <br />Cape Cod Retired Senior Volunteer Program or take any other action thereon. <br />ACTION: Motion duly made and seconded to transfer from available funds the <br />sum of $125.00. So voted. <br />Article 20: To see if the Town will assume liability in the manner provided <br />' by Section 29 of Chapter 91 of the General Laws, as most recently amended by Chapter5 <br />Acts of 1955, for all damages that may be incurred by work to be performed by the <br />Department of Public Works of Massachusetts for the improvement, development, <br />maintenance and protection of tidal and non -tidal rivers and streams, harbors, <br />tidewaters, foreshores and shores along a.public beach, including the Merrimack <br />and Connecticut Rivers, in accordance with Section II of Chapter 91 of the General <br />Laws, and authorize the Selectmen to execute and deliver a bond of indemnity therefor <br />to he Commonwealth. <br />ACTION: Motion duly made and seconded to accept Article 20 as read. So voted. <br />Article 21. To see if the Town will vote to raise and appropriate or take <br />from available funds the sum of $6,000.00 for the purpose of a comprehensive study <br />of the water and environmental quality of John's Pond, Ashumet Pond, Santuit Pond <br />and Mashpee-Wakeby Pond; and to establish water criteria standards for fresh ponds <br />and wetlands and to monitor same. Said project to be done by a registered professional <br />engineer with State laboratory certification. <br />ACTION: Motion duly made and seconded to accept Article 21 as read. <br />A unanimous vote. (The sum of $6,000.00 to be raised and appropriated.) <br />Article 22. To see if the Town will vote to raise and appropriate or take <br />from available funds the sum of $1,334.00, said sum for the Mashpee American Legion <br />Post #262 rent, or take any other action thereon. <br />' ACTION: Motion duly made and seconded to indefinitely postpone Article 22. <br />So voted. (It was acted upon in the Budget Article) <br />Article 23. To see if the Town will vote to accept an easement from Fields <br />Point Manufacturing Co. for all purposes for which easements are commonly used <br />within the Town of Mashpee, including the installation and use of utilities on and <br />over the following described land: <br />WESTERLY by land now or formerly of John H. Brooks, Jr., as shown on <br />hereinafter mentioned plan two hundred ninety and 82/100 (290.82) feet; <br />NORTHERLY by land of the Town of Mashpee, as shown on said plan, three hundred <br />and 00/110 (300.00) feet; <br />EASTERLY and NORTHEASTERLY by land of Fields point Manufacturing Co. <br />as shown on said plan, thirty and 00/100 (30.00) feet, and four hundred and <br />00/100 (400.00) feet, more or less, respectively; and <br />SOUTHERLY by Route 151, so-called, as shownon said plan, five hundred and <br />00/100 (500.00) feet. Said parcel is delineated on a plan of land entitled, "Pole <br />Locations, Mashpee Municipal Complex, Mashpee, Mass., Scale 1 in. equals 30 ft., <br />October, 1974, Barnes Engineering Company, Inc., 411 Lexington Street, Auburndale, <br />Mass." <br />Said easement shall entitle the Town: <br />to build, maintain and use two driveways running approximately north and <br />south over said area, the paved parts of said driveways not to be closer than <br />' twenty (20) feet from the side lines of said easements; to build, maintain and <br />use walkways; <br />To improve said area by selectively clearing, brushing, planting and <br />landscaping; <br />To install park benches and other improvements customarily situated in <br />park areas. <br />S id grant of easement shall not include the right to permit the parking of <br />vehicles nor the right to erect or maintain a building within the area of said <br />easement. <br />ACTION: Motion duly made and seconded toagccept Article 23 as read.
