365 <br />Annual Town Meeting Page 21 May 4, 1976 <br />Section 7 <br />In the event that any provision, section or clause of this By -Law is hereafter <br />judicially found to be invalid, such decision, invalidity or voidance shall not affect <br />the validity of the remaining portions of this by-law. <br />ACTION: Moved and seconded to amend Article 80: <br />Section"1 - Speed Regulations <br />' No person shall operate a motor boat, as defined in Chapter 90B of the <br />Massachusetts General Laws on the ponds of Mashpee within (150) one hundred and <br />fifty feet of shore at a rate of speed in excess of (6) six miles per hour. No <br />person shall operate a motor boat in any area of any pond at a speed greater than <br />(6) six miles per hour during the period from one hour after sunset to one hour <br />before sunrise. <br />Section 2 - Water Skiing <br />There shall be no water skiing within (150) one hundred and fifty feet of <br />shorelines, bathers, boats underway by means other than motors, or boats not <br />underway, nor in shallow or narrow areas properly posted as "no wash", "no wake", <br />or "6 MPH maximum speed" areas. Ski starts and stops shall 'not be permitted <br />within (150) one hundred and fifty ibet of any shoreline except that the Town may <br />designate an area or areas which will be properly posted indicating that starts <br />and stops are permitted from shore within this specified beach area. All turns <br />shall be in a counter clockwise direction. No person shall operate a motor boat while <br />drawing more than two water skiers at the same time. No person shall water ski <br />except during the hours of from one-half hour after sunrise and one-half hour before <br />sunset. There shall at all times be a competent person in addition to the operator <br />in a position to observe the person or persons being towed. <br />Section 3 - Age of Motor Boat Operator <br />' Delete in its entirety, <br />iSection 4 - Penalties for Violations <br />Change number to read Section 3 <br />Section 5 - Enforcement <br />Change number to read Section 4 <br />Section 6 - Signs <br />Change number to read Section 5 <br />Section 7 <br />Change number to read Section 6 <br />Moved and seconded to accept above amendments. Vote carried. <br />Five historical prints over 150 years old were presented to the Mashpee <br />Public Library by Mr. Elio P. Oliva. A picture of Chief Wild Horse was also <br />presented to the Town by Mr. Oliva. <br />May 4, 1976 -- Meeting adjourned at 11:10 P.M. <br />' May 5th, 1976 --- Meeting opened at 7:15 P.M. <br />ARTICLE 81. To see if the Town will vote to increase the size of the <br />Mashpee School Committee, from 3 (three) members to 5 (five) members, said <br />additional two members to be appointed by the Board of Selectmen, one member to <br />serve fof two years and one member to serve for one year. Thereafter, said <br />members shall be elected on the ballot at the Annual Town Election, or take any <br />other action thereon. Submitted by the Board of Selectmen. Submitted by the <br />Mashpee Taxpayers Association. <br />
