425 <br />Annual Town Meeting <br />-11- <br />May 1, 1978 <br />ARTICLE 13. To see if the Town will vote to adopt the provisions <br />of Chapter 808 of the Acts of 1975, as amended, and to amend <br />Section 2 of the Zoning Bylaw by adding thereto the following: <br />"2.31 Special Permit Granting Authority -- shall be the Board <br />of Appeals unless specifically designated in any section of <br />this Bylaw to another authorized Board or Agency as allowed <br />under Chapter 808 of the Acts of 1975, as amended" <br />and to amend Section 4 of the Zoning Bylaw by adding thereto the <br />following paragraph: <br />"4.7 Construction or operations under a building permit or <br />special permit shall conform to any subsequent amendment of <br />the Zoning Bylaw unless the use or construction is commenced <br />within a period of not more than six months after the issu- <br />ance of the permit and in cases involving construction, <br />unless such construction is continued through to completion <br />as continuously and expeditiously as is reasonable." <br />and to amend Section 5 of the Zoning Bylaw by deleting from <br />Section 5.1 the period following the last word and adding thereto <br />the following: <br />"5.1, and further provided that the Board finds that such <br />change, intensification, extension or enlargement shall not <br />be substantially more detriment al than the existing non- <br />conforming use to the neighborhood." <br />and to amend Section 5 of the Zoning Bylaw by adding thereto the <br />following: <br />"5.5 Any lot shown on a plan and lawfully in existence in <br />compliance with the pr.6visions of the Subdivision Control <br />Law (Chapter 41 of the General Laws), as of January 1, 1977, <br />may thereafter be built upon for residential use." <br />and to amend Section 6.3, B, 3 by deleting the period following <br />the words "supporting facilities" and adding the following- <br />", and uses." <br />and amend the Section 6 by adding thereto the following: <br />"6.21 Any Special Permit granted by the Board of Appeals <br />shall be issued only following a public hearing which shall <br />be held within 65 days after the filing of an application <br />therefor with the Town Clerk, a copy of which shall forth- <br />with be given to the Board of Appeals by the applicant. <br />"6.22 Any special permit granted by the Board of Appeals <br />shall lapse within one year from the grant thereof, including <br />such time required to pursue or await the determination of <br />any appeal, if a substantial use thereof has not sooner <br />commenced except for good cause, or, in the case of a permit <br />for construction, if construction has not begun by such date <br />except for good cause. <br />"6.23 Any use, whether or not on the same parcel as activi- <br />ties permitted as a matter of right, accessory to activities <br />permitted as a matter of right, which activities are neces- <br />sary in connection with scientific research or scientific <br />development or related production may be permitted upon the <br />issuance of a special permit provided the Board of Appeals <br />finds that the proposed accessory use does not substantially <br />derogate from the public good." <br />and amend Section 12 by deleting therefrom 12.1 in its entirety <br />and substituting therefor the following: <br />"12.1 There shall be a Board of Appeals as provided for by <br />the Massachusetts General Laws consisting of three members. <br />The Board of Selectmen shall appoint the members annually <br />to a term commencing July 1st. The members shall be appointed <br />for a term of three years with the term of one member to <br />expire each year. The Board of Selectmen may appoint up to <br />six associate members for similar terms in the same manner. <br />Vacancies shall be filled for unexpired terms in the same <br />manner as in case of original appointments." <br />12.2 The Board of Appeals shall organize annually at the meet- <br />ing next following July 1st by the election of a chairman and <br />i <br />
