Im <br />Annual Town Meeting <br />-12- <br />May 1, 1978 <br />a clerk from within its own membership, and may, subject <br />to appropriation, employ experts and clerical and other <br />assistants." <br />"12.3 The Chairman of the Board of Appeals may designate <br />any associate member to sit on the board in case of <br />absence, inability to act or conflict of interest on the <br />part of any member thereof or in the event of a vacancy <br />on the board until said vacancy is filled by action of <br />the Board of Selectmen. <br />"12.4 Any member or associate member of the Board of <br />Appeals may be removed for cause by the Board of Select- <br />men but only after written charges have been made and <br />delivered to the member and a public hearing has been <br />held." <br />"12.5 The Board of Appeals shall have and exercise the <br />powers specifically granted by the General Laws of the <br />Commonwealth and those powers granted in this Zoning By- <br />law which are not inconsistent with the aforesaid <br />General Laws." <br />"12.6 The Board of Appeals shall have the power to autho- <br />rize a use or activity not otherwise permitted in the <br />district in which the land or structure is located, but <br />only upon the application of the standards set forth in <br />the General Laws of the Commonwealth for the grant of a <br />variance." <br />and to amend Section 14 by adding thereto the following; <br />"14.5 If the Building Inspector after being requested in <br />writing to enforce the Zoning Bylaw against any person <br />allegedly in violation of the Zoning Bylaw declines to <br />act, he shall notify, in writing, the party requesting <br />enforcement of any action he takes or refusal to act, <br />and the reasons therefor, within 14 days of receipt of <br />' <br />the written request for enforcement." (Submitted by <br />the Planning Board) <br />ACTION: Motion made and seconded that Article 13 be <br />accepted as printed with the following two amendments: <br />Paragraph 5.5 -- Delete the last three words "for <br />residential use". <br />Paragraph 6.22 -- Change "one year" to "two years". <br />Article 13 carried with a unanimous vote. <br />ARTICLE 14. To see if the Town will vote to adopt the follow- <br />ing bylaw, pursuant to the authority granted by Chapter 693 <br />of the Acts of 1977, to be added to the revised Bylaws of the <br />Town of Mashpee Chapter III, Article X: <br />Section I; <br />"The Town shall be authorized to make temporary repairs <br />on all private streets and ways to which the public has a <br />right of access excluding, however, any private street or way <br />which was laid out in accordance with the provisions of the <br />subdivision control law as appears innChapter 41 of the Mass- <br />achusetts General Laws and concerning which the Planning Board <br />has not accepted said private street or way as conforming to <br />subdivision rules and regulations governing the construction <br />of ways by the release of covenant or other security held by <br />the Town for the completion of construction of the ways. <br />"Such temporary repairs shall include the filling of <br />holes in the subsurface of such ways and repairs to the sur- <br />face materials thereof; and materials for such repairs shall, <br />where practical be the same as, or similar to, those used for <br />the existing surfaces of such ways, but may include the oiling <br />or tarring of said ways and the covering of such oil or tar <br />with sand or gravel. <br />"Such temporary repairs may include the diversion and <br />dispersal of accumulated surface water. <br />
