444 <br />Special Town Meeting <br />Article 5 continued <br />-4- <br />November 15, 1978 <br />"If such sand and gravel pit is opened and used, the owner <br />shall remove and dispose of all dead trees -and stumps when any <br />area thereof amounting to more than 5,000 square feet becomes <br />unsuited for further use, and in such case, such area shall be <br />;ereplanted with trees or shrubs to prevent soil erosion." <br />ACTION: Moved and seconded that Article 5 be accepted as <br />read. 95 votes for, -8 opposed.. <br />ARTICLE 6.• To see if the Town will vote to amend the Zoning By - <br />Law, Section 6.31, Accessory'Uses, by,adding thereto the follow- <br />ing: <br />"8. Private ways for access through Commercial District <br />C-2 to Industrial District I-1, subject to compliance with <br />applicable subdivision control laws and regulations." <br />and by adding "SP" under the applicable column entitled "Com- <br />mercial -C2". <br />ACTION: Moved and seconded that Article 6 be accepted as <br />read. Passed by a Unanimous Vote. <br />ARTICLE 7. To see if lthe Town will vote to amend the Zoning By - <br />Law by adopting a zoning map entitled "Zoning Map of the Town of <br />Mashpee, Massachusetts -- Scale 1 inch = 1,000 feet, November <br />1978", which map is on file with the Town Clerk and which map <br />redesignates alloor;;port,ions of the existing R-1 and R-2 Districts <br />and adds an R-3 District, and by adding to Section 3.1, under <br />Residence District R-2 the words "R-3" and by deleting in Section <br />3.2 line 4 the words "August 4, 1971" and substitutingg therefor <br />the words "November, 1978", and.by adding to Section.6..,3, under <br />the column. entitled Residential, the designation "R3" and by <br />thereafter indicating the said RD column the same uses allowed <br />in the R2 District as presently appears in Section 6.3 and by <br />amending Section 7.4 by deleting therefrom the present R1 and R2 <br />Residence Districts in.their entirety and by substituting there- <br />for the following: <br />LAND SPACE REQUIREMENTS TABLE <br />Zoning Min. To see if the Town will vote to amend the Zoning By - <br />Law by deleting from Section 9.322, line 3, the words "Five units" <br />and substituting therefor the words "four units".and by deleting <br />Section 9.3621, Section 9.3622 and Section 9.3623 in their <br />entirety and substituting therefor the following: <br />"9.3621 PUBLIC OWNERSHIP --The common open space shall be conveyed <br />to the Town of Mashpee and accepted by it for park or open•space <br />use. <br />"9.3622 OWNERSHIP BY NON-PROFIT ORGANIZATION --The common open <br />space shall be conveyed to a non-profit organization, the prin- <br />ciple purpose of which is the conservation of open space.
