443 <br />Special Town Meeting -3- November 15, 1978 <br />"Section 1: Regulation of Temporary or Transient Vendors <br />"Every person who engages in a temporary or a transient <br />business selling foods, wares, periodicals, or merchandise, <br />or who goes door to door for any commercial selling purposes, <br />either as a principal or agent, shall, before commencing <br />business in the Town of Nfashpee, make written application, <br />under oath, for a license to the Chief of Police, stating his <br />or her name and address, the name and address of the owner or <br />parties in whose interest said business is to be conducted, <br />their business address, and a brief description of the busi- <br />ness he wishes to conduct in Mashpee. Said person shall <br />further furnish the names and addresses of all other persons <br />who will participate in the conducting of said business in <br />the Town of Mashpee. He or she shall permit the Police <br />Department to photograph and fingerprint him or her for the <br />purpose of identification. <br />"No later than one week after the filing of such application, <br />the Chief shall issue him or her a license. The license shall <br />be a license in the form of a badge authorizing him or her to <br />do the business described in his or her application subject to <br />the By -Laws of the Town of Mashpee and the Laws of the Common- <br />wealth of Massachusetts. The license shall expire on <br />December 31st or on the day of its surrender to the Police <br />Department, or, on the filing of an affidavit of its loss with <br />the Police Department. <br />"Such license shall be affixed in.a prominent place to the <br />outer garment of each licensee whenever he or she shall be ' <br />engaged in such business so that it may be seen by all pro- <br />spective customers. <br />"It shall be unlawful to engage in any of the herein above <br />enumerated businesses except in compliance hereof. <br />"Failure to display the license shall be punishable by <br />revocation thereof. <br />"The provisions of this section shall not apply to any person <br />conducting a "garage sale" nor to any person who goes door to <br />door to sell goods, wares, periodicals, or merchandise on be- <br />half of any group or organization for any of the purposes <br />described in MGL Chapter 180, Section 2. <br />"Whoever violates the rovisions of this Section shall be <br />punished by a fine of 200.00 and each day a violation occurs <br />shall be considered a separate offense." <br />ACTION: Moved and seconded to accept Article 3 as prin- <br />ted. A Unanimous Vote. <br />ARTICLE 4. To see if the Town will vote to amend Chapter III <br />of the By -Laws of the Town by adding thereto the following: <br />"Section 12: Penalties <br />"Whoever violates any of the provisions of Chapter III of the <br />By -Laws, unless otherwise provided for therein, shall be <br />unished by a fine of not less than $20.00, nor more than <br />50.00. Each day a violation occurs shall be considered a <br />separate offense." <br />ACTION: Moved and seconded that Article 4 be amended to <br />read as follows: <br />Chapter III, Article V. <br />"Section 12: Penalties <br />"Whoever violates any of the provisions of Chapter III, <br />of the By -Laws, etc." <br />Passed by a unanimous vote. <br />ARTICLE 5. To see if the Tows will vote to amend the Town of <br />Mashpee By -Laws, Chapter III, Section 3, Article IV, Removal <br />of Soil, Sand and Gravel and Pits by deleting therefrom the <br />second sentence in its entirety and substituting the following: <br />
