446 's Special Town Meeting -6- November 15, 1978 C Article 9 continued or trust shall execute a restriction enforceable by the Town of Mashpee which shall be recorded at the Barnstable County Regis- try of Deeds and said restriction shall provide that such land shall be kept in an open and natural state and not be built for residence use or developed for accessory uses such as parking or roadway. The corporation or trust shall own and maintain the open space and shall not dispose of any of the open space by sale or otherwise except that said corporation or trust may offer to convey such open space to the Town of.Mashpee for acceptance by it for park or open space use." ' and further by deleting section 9.42 sub -paragraph 10. in its entirety and by substituting therefor the following: "10. each lot shall contain not less than 15,000 square feet." and further by adding. the following:... "Section 9.43 The Board of Appeals shall transmit to the Plan- ning Board and to the applicant the decision of the Board of Appeals within ninety (90) days following :the date of the public hearing. Approval by the Board of Appeals shall be conditioned upon approval of the Planning Board under the subdivision con- trol law and as provided for herein.` and further by adding the following: "Section 9.44 Planning Board Approval -- The Developer shall be required to comply with all of the provisions set forth in Section 9.38 upon approval by the Board of Appeals of the Special Permit." ACTION: Motion made and seconded that Article 9 be accepted as printed. Motion carried. 112 for, 2 opposed. ARTICLE 10. To see if the Town will vote to transfer from avail- able funds the sum of $1,500, or any other sum, for the purpose I of printing new zoning maps and new zoning by-laws, or take any other action thereon. ACTION: Motion made and seconded to amend Article 10 to read: to transfer from Revenue Sharing funds the sum -of $1,500, etc." Motion carried. ARTICLE 11. To see if the Town will accept the provisions of Chapter 147, Sections 32-51 of the Massachusetts General Laws, as amended from time to time. ACTION: Moved and seconded to amend Article 11 to read: To see if the Town will accept the provisions of Chapter 147, Sections 32-47 and 50A of the Massachusetts General Laws, as amended from time to time. Motion carried. ARTICLE 12. To see if the Town will vote to approve one addi- tional member to augment the present town maintenance crew and to transfer the sum of $5,277, or any other sum, from Anti - recession Fiscal Assistance Title II funds, or other available funds, to be applied to the Maintenance Unit Wage Account, or take any other action thereon. ACTION: Moved and seconded to accept Article 12 as read. Motion carried. 81 for, 33 opposed. ' ARTICLE 13. To see if the Town will vote to transfer from'the Revenue Sharing Account the sum of $ , or any other sum, to meet the adjusted obligation of the new contract between the Town of Mashpee and the Mashpee Police Employees Association, Inc., for the Fiscal Year July 1, 1978, to June 30, 1979, or take any other action thereon. ACTION: Motion made and seconded that Article 13 be In- definitely Postponed. Motion carried.
