446 's <br />Special Town Meeting -6- November 15, 1978 <br />C <br />Article 9 continued <br />or trust shall execute a restriction enforceable by the Town of <br />Mashpee which shall be recorded at the Barnstable County Regis- <br />try of Deeds and said restriction shall provide that such land <br />shall be kept in an open and natural state and not be built for <br />residence use or developed for accessory uses such as parking <br />or roadway. The corporation or trust shall own and maintain the <br />open space and shall not dispose of any of the open space by <br />sale or otherwise except that said corporation or trust may offer <br />to convey such open space to the Town of.Mashpee for acceptance <br />by it for park or open space use." ' <br />and further by deleting section 9.42 sub -paragraph 10. in its <br />entirety and by substituting therefor the following: <br />"10. each lot shall contain not less than 15,000 square feet." <br />and further by adding. the following:... <br />"Section 9.43 The Board of Appeals shall transmit to the Plan- <br />ning Board and to the applicant the decision of the Board of <br />Appeals within ninety (90) days following :the date of the public <br />hearing. Approval by the Board of Appeals shall be conditioned <br />upon approval of the Planning Board under the subdivision con- <br />trol law and as provided for herein.` <br />and further by adding the following: <br />"Section 9.44 Planning Board Approval -- The Developer shall be <br />required to comply with all of the provisions set forth in <br />Section 9.38 upon approval by the Board of Appeals of the Special <br />Permit." <br />ACTION: Motion made and seconded that Article 9 be accepted <br />as printed. Motion carried. 112 for, 2 opposed. <br />ARTICLE 10. To see if the Town will vote to transfer from avail- <br />able funds the sum of $1,500, or any other sum, for the purpose I of printing new zoning maps and new zoning by-laws, or take any <br />other action thereon. <br />ACTION: Motion made and seconded to amend Article 10 to <br />read: to transfer from Revenue Sharing funds the sum -of $1,500, <br />etc." Motion carried. <br />ARTICLE 11. To see if the Town will accept the provisions of <br />Chapter 147, Sections 32-51 of the Massachusetts General Laws, <br />as amended from time to time. <br />ACTION: Moved and seconded to amend Article 11 to read: <br />To see if the Town will accept the provisions of Chapter 147, <br />Sections 32-47 and 50A of the Massachusetts General Laws, as <br />amended from time to time. Motion carried. <br />ARTICLE 12. To see if the Town will vote to approve one addi- <br />tional member to augment the present town maintenance crew and <br />to transfer the sum of $5,277, or any other sum, from Anti - <br />recession Fiscal Assistance Title II funds, or other available <br />funds, to be applied to the Maintenance Unit Wage Account, or <br />take any other action thereon. <br />ACTION: Moved and seconded to accept Article 12 as read. <br />Motion carried. 81 for, 33 opposed. ' <br />ARTICLE 13. To see if the Town will vote to transfer from'the <br />Revenue Sharing Account the sum of $ , or any other sum, <br />to meet the adjusted obligation of the new contract between the <br />Town of Mashpee and the Mashpee Police Employees Association, <br />Inc., for the Fiscal Year July 1, 1978, to June 30, 1979, or <br />take any other action thereon. <br />ACTION: Motion made and seconded that Article 13 be In- <br />definitely Postponed. Motion carried. <br />
