-6- <br /> Mr. Hennigan:_ I have recommended to this Commission and I think that they will take <br /> it under advisement that an Order of Conditions be issued specifically setting forth <br /> protective language that they want so badly and I don't blame them, I would do it tool <br /> in that the systems installed shall meet Title V in the Commonwealth of Massachusetts <br /> and be installed in such a way so as not to interfere as impose a threat to the surround- <br /> ing area or the environment. We have substantiated documentation from the Board of <br /> Health and the Shellfish Warden saying that It should not impose any threat. Now, if <br /> the Commission has any other suggestions . . . <br /> Pauline: I have one question and, I have to consult DEQE as to just what the exact pro- <br /> cedure is after denial. What is the time limit. This I am not sure of myself. <br /> Mr. Hennigan: You have twenty-one days. <br /> Pauline: Because you have not appealed it. <br /> Mr. Hennigan: I did not want to do that. Because this is a ridiculous approach, it ties <br /> up everybody. <br /> Pauline: (Our twenty-one day time limit is by-passed us now. This is why I have to look <br /> out for the Board's safety, my own, and what the legal procedure is under the State law. <br /> Mr. Hennigan: You have already conducted a continuance. This is what we had here this <br /> evening. As of tonight, this is the beginning of your twenty-one days legally. <br /> Pauline: But legally a continuance was not typewritten and submitted. <br /> George Benway: What you are asking that after the twenty-one days have gone by, when <br /> can a re-submittal be made? <br /> Dorothy: If he submitted an appeal . . . <br /> Pauline: But he didn't submit an appeal. This is why I have to check on the timing. <br /> Dorothy: Asks Mr. Hennigan: Did you appeal :a denial order from DEQE? <br /> Mr. Hennigan: No. The appeal process is still open. <br /> Pauline: The ?3rd of December it was appealed. <br /> Mr. Hennigan: Legally, if you issue an Order of Conditions any time within twenty-one <br /> days from tonight it is legal. I have some amendments that I am going to give you. <br /> Pauline: Well, this is what I have to check for myself. We will let you know on this. <br /> George Benway: The Sanchez's are looking for your help as a Committee to show them how <br /> to construct the septic tanks and so forth to conform to the prescribed regulations. I <br /> know them and they are looking for your help. <br /> Mr. Hennigan: I am sure they will find it. Before we close are there any questions? Is <br /> there any advise that I can give,; <br /> you and I am not talking about the commission's ruling, <br /> but engineering wise as a Sanitary Engineer. <br />
