So if these were moved back. . . I don't know. How does the rest of the board <br /> feel? <br /> Wayne: It requires a variance. <br /> Dorothy: We do not have any power to issue any variance. <br /> Wayne: That is what I was wondering if it is our problem or the Board of Health's problem. <br /> Pauline: It is our problem because we denied them because of the location. <br /> Atty. Thomas Boyd: The Board of Health has approved these as far-as I can see from all the <br /> information Mr. Hennigan gave me. There is a letter here from Charles Lawrence and the <br /> last paragraph says that this department concurs with the Shellfish Warden's evaluation, <br /> paragraph 3 of his letter, in that the proposed system properly installed should pose no <br /> serious threats to the surrounding area. <br /> Pauline: And that is signed by whom? <br /> Atty. Boyd: Charles Lawrence. It is dated January 3, 1980. <br /> Barbara: When did we have that_on site inspection done? <br /> Atty. Boyd: I believe that in one point in time someone went out to the property and there <br /> were two holes dug that were just dug -- testing holes. And one of them was . improperly <br /> designated as one of the systems. So that when the party went out there, they said that it <br /> was too close -to everything. Now, I have gone over this somewhat and as far as I can see <br /> that everything that has been submitted here, everybody has concurred that the placement of <br /> septic tanks are within proper designated places and even DEQE has. <br /> Pauline: DEQE has? DEQE did an on site inspection. <br />
