I think that is referred to by the Shellfish Constable in his letter. <br /> Pauline: The main thing on this was, after denial Mr. Hennigan had ten days to appeal. <br /> He should of appealed and you can at any time refile. <br /> Mr. Benway: The heck with that we know that. <br /> Pauline:- Yes, but we cannot issue an Order of Conditions. <br /> Mr. Benway.: They are not looking for that. They are looking for advise on how to pro- <br /> ceed right now. Just to file blankly means that you are going to meet again and you are <br /> going to say well that's not enough. They cannot file much more than what is in front of <br /> you right now unless you specifically tell them what you want. Now I don't know, for ex- <br /> ample, the lot on the right (the southerly lot) -- has any determination been made by this <br /> Board in its Order Of Conditions that the plans as filed are not acceptable. ' <br /> Pauline: We did not issue any Order of Conditions. We just issued the Denial. <br /> Mr, Benwayc.. Does that cover both -- the whole thing? <br /> Pauline: Right. Because there were two or three extra holes in here that were only dug <br /> down thirty-three inches or so, <br /> Atty. Boyd: That is the test pits. <br /> Mr. Unway: . My next question would be: The lot on the right, the southerly lot, -- . as <br /> the Conservation Board sees it and has reviewed it and has considered it -- are there <br /> problems with that particular plan as outlined right now? <br /> Dorothy: My feelings would be that this leaching field right here is not placed correctly. <br /> It could be placed further back from this road so that it is further away from the marsh on <br /> this side. <br /> Pauline: It would have to be preferably in the middle because you have the Bay on this <br /> side and the marsh on that side. <br /> Dorothy: I don't think it has to be an equal distance. <br /> Pauline: - As long as it doesn't interfere with the well water. <br /> Atty. Boyd: How far do you have to be -- fifty feet? <br /> Pauline: The town law is seventy-five. Whether you have a variance by the Board of Health, <br /> it has been okayed by the Board of Health. <br /> Mr. Benway: Measures distance with a ruler. There is a bit of a banking. Will you agree <br /> thatthere is maybe four to five feet of banking? <br /> Pauline: Yes, in some areas. <br /> Mr. Benway: I travel it every day. <br /> Barbara: No, I cannot say there is four to five feet in there. <br />
