-14-
Atty. Boyd: May I ask a technical question? You have denied the initial petition --
what I am trying to bring out is why do we have to go through this whole thing again?
And then there is a waiting period-and then there is an appeal period. Isn't it in
order to request the board to revoke and revise their order of denial?
Pauline: I have doubled checked with the Mass. Law of Foundation and with DEQE and they
told me that after denial you will have to refile.
Mrs. Sanchez: Will it take very long?
Mr. Benway: Three weeks.
Mrs. Sanchez: That is fine.
Barbara: Let it go on record that I am disassociating myself from the Sanchez case.
TOWN WATER
Pauline: I found this letter in my box upstairs re: the Mashpee Town Water System,
dated February 22, about a deal that the Board of Health and Planning Board are trying
to set up for a Town Water Study Committee. The meeting was scheduled for February 20.
MACC MEETING
Pauline: Is anybody planning to go to the MACC meeting on March 8?
Board: No.
NEW BILL, H. 1222
Pauline: We received a letter from Arlene Wilson, dated February 22, 1980, regarding a
new bill which is being proposed in which they are trying to take home rule out of Con-
servation and give it all to the state. The hearing on the bill will be on March 111
Wayne: Reads the letter.
Pauline: What it boils down to is Dennis' by-law and our by-law. They have all the Con-
servation Commissions going to town meetings copying Dennis ' by-law word for word because
it supersedes the State. So the State is trying to wipe it out by putting a bill in the
legislature.
Dorothy: How can they do that? Our town by-laws are stronger than the State law.
Pauline: They are trying to eliminate it to make it uniform and the State will come in
and control all the wetlands and what have you.
Wayne: It is good if they can upgrade their statutes.
Pauline: If they have a staff to do it. What is the purpose of the Conservation Commis-
sion? I will tell you what I think it is. It is the same thing that applies to the Appeals
Board. Why was an Appeals Board established? To break the law that has been established.
Now what does the Conservation Commission do? We are breaking the law that the State .
