-13- <br /> Pauline: Can I go back in history for a minute? That area, Daniels Island, is all <br /> fill and we questioned what was under there -- whether there is bog under there. Be- <br /> cause that Island was a complete island at one time. We were questioning whether or <br /> not that fill which was put in would filter through. <br /> Mr. Benway: I know this area. This is .not fill. Nobody could afford fill then. The <br /> only fill on the Island is that portion to the left where Wiseman's built a garage. <br /> Atty. Boyd: (Reads Barbara's question to Mr. Hannigan on page 2 of January 9, 1980's <br /> minutes "My question is with this septic system that you are going to put in, how far <br /> are you from this water?" and Mr. Hennigan's replies: "We will be within 60 feet or 50 <br /> feet." If you are within 50, are you within the limits? <br /> Pauline: No. The Wetlands Act, Chapter 131, Section 40, says anything being built <br /> within 100 feet has to come to the Conservation Commission and that is whyyouu.are here. <br /> And this is part of it. It is less than 40 feet on the original plan. <br /> Barbara: I questioned it because he didn't show water on his plan on the other side of <br /> Daniels Island. <br /> Pauline: He didn't show any marsh. <br /> Barbara: And I wanted to make sure that you were all aware that there is definitely tidal <br /> waters. <br /> Mrs. Sanchez: How do we proceed now? Who does the staking? <br /> Pauline: You do. Then you file a Notice of Intent. <br /> Mrs. Sanchez: And then you people will approve the stakes and we will submit a new drawing <br /> and then we should be all right. <br /> .Pauline: Gives the Sanchez 's a form to file and tells them to make sure it is all sent <br /> certified mail and send a $25 check to the town when filing Notice of Intent. <br /> Mrs. Sanchez: And should we come back again and have another meeting? <br /> Pauline: I will notify you when we have the hearing. As soon as I receive the Notice of <br /> Intent, certified mail, within so many days I have to set up a hearing. Then we will take <br /> it from there and will issue an Order of Conditions. <br /> Mr. Benway: I would like to do this if it is agreeable for both parties so that we know we <br /> are headed in the right direction. After these proposed locations for the leaching fields <br /> or diffusers is located and staked, then Pauline or somebody from the Conservation come <br /> down and say this is okay and we will just make a note of that and send it to the Sanchez's <br /> so that they know they are on the right track. <br /> Mrs. Sanchez: Could you do that and then we will go ahead with the drawings? <br /> Mr. Sanchez: Because up to now we have been confused by the whole thing. <br /> Mrs. Sanchez: We didn't really understand it. <br /> Wayne: What it boils down to is that the board cannot design the system. We have to take <br /> explicitly what is presented to us and that is why the denial was made. <br />
