CONSERVATION BOARD MEETING <br /> April 2, 1980 <br /> Present: <br /> Pauline F. DeLory, Chairperson <br /> Dorothy G. Studley, Vice Chairperson <br /> Barbara Sloane <br /> Wayne Tavares <br /> Ken Pecci <br /> The meeting was called to order promptly at 7:30 p.m. <br /> Two hearings are scheduled for the April 23 meeting at 7:30 and 7s45 p.m. -- <br /> John T. and Eva K. Breyer, Popponesset Island Rd. -- no house on lot. Pauline, <br /> Charlie and Barbara made a determination. They are applying foran 82 foot pier. <br /> Dick Morse is also applying for an 82 foot pier with 38 feet on the marsh. This <br /> is on Great River. Mr. Braman of Eldredge Engineering is representing both of <br /> the above. <br /> Deane Beggs, Jr. <br /> River Road <br /> Agents Phil Holmes <br /> Order of Conditions: <br /> 11. Must comply with plans submitted. <br /> 12. All excess fill to be removed from the banking and stored 100 feet above mean <br /> high water. <br /> 13. No construction machinery to be worked within 90 feet of the mean high water. <br /> 14. All docks, piers or construction below mean high water shall require separate <br /> filing with the Mashpee Conservation Commission. <br /> Protection Zoning By-Law <br /> Mashpee River <br /> Dick Terry: Explains primary purpose of this by-law -- What it entails is the prohibi- <br /> tion of building 100 feet from the bank of the river starting north from the beginning <br /> of the river all the way down to the Pirates Cove area. Pirates Cove will be excluded. <br /> Maps are available showing where the 100 foot line would be involved. The by-law itself <br /> does provide for harship in terms of going before the Board of Appeals. There is a pro- <br /> vision in the by-law for placement of docks in the area. The basic idea behind the by- <br /> law was thought that the Mashpee River is a very special area and the pristine nature of <br /> the river itself. The Board feels that the '100 foot prohibition on building is basically <br /> keeping with the spirit of conservation. It is not intended to try and take anyone's <br /> property rights away. The idea is to try and preserve that portion of the Mashpee River <br /> that really hasn't been touched or built upon. There is no attempt to excerpt the powers <br /> of the Conservation Commission. Any existing use prior to this would be exempt. <br />
