k <br /> -13- <br /> Charles: That was not within our purview. That was the whole thing because that house <br /> was decided upon at one time. He kept his building permits up. He was in before the <br /> floodplain. The only condition that we could find and the only objection we were able <br /> to make that was in our purview was that he had sacrificed the beach grass and .that he <br /> has replaced. <br /> Paulinet I just received a call from David Nailor of Osterville whom I confronted <br /> Mr. Ferguson with and he said he never hired Mr. Nailor. He wanted to know what ever <br /> happened and was the foundation filled in because it was in the floodplain and what did <br /> the building inspector do. <br /> Charles : Refer him to the building inspector and let the building inspector take it from <br /> there. This was all done before floodplain was accepted by the Town of Mashpee. <br /> Pauline: Mr. Nailor also asked about the septic system being within 10 feet of the <br /> attorney next door home. <br /> Challes: That has all been taken care of. <br /> Pauline: They put that in the 10 foot easement. This lot has only a 10 foot frontage on <br /> the beach street. Mr. Ferguson owns the abutting lot so it is just a little 10 foot way. <br /> Barbara and I were down to look at it and there was a clothes line on it. They had filled <br /> in right over the marsh and right onto the beach at that time and right up to the abutters <br /> house. <br /> Barbara: May I quote you? "The only grounds that we have is that his application is not <br /> valid and he has not renewed." The April 20th minutes were missing. <br /> Charles: That was when we lost our secretary. <br /> Mr. Scalley stopped in to see about his Order of Conditions, SE#43-120. He was told that <br /> they would be in the mail tomorrow (5/15/80). He requested that they be mailed to him. <br /> Pauline told him he would receive a copy, but the original has to go to the owner of record. <br /> This is for the house on John's Pond, 289 Cranberry Avenue. Raduano <br /> sE43-116 <br /> Pauline: A superseding Order of Conditions will be coming down from DEQE. According to <br /> Mr. Hollander, he and Mr. Raduano almost came to blows and Bryan Donahue had to separate <br /> them. <br /> Deane Beggs, Jr. <br /> River Road, Mashpee <br /> Pauline: This is also being re-written by DEQE. They will not require a Chapter 91 <br /> license either. The reason for the appeal lies in the lack of condition regarding future <br /> erosion control as outlined in section 33 (3) and 30 (5), the coastal wetlands, August 10, <br /> 1978. <br />
