DRAFT FOR REVIEW AND COMMENT <br /> ARCHITECTURAL CONSERVATION DISTRICT COMMISSION POWERS <br /> AND DUTIES <br /> The Commission shall exercise its powers in administering and regulating the alteration <br /> of buildings within the architectural conservation district as set forth under the procedures <br /> and criteria established in this bylaw. <br /> The Commission, after a public hearing duly posted and advertised at least 14 days in <br /> advance in a conspicuous place in Town Hall, may adopt and from time to time amend, <br /> reasonable Rules and Regulations not inconsistent with the provisions of this bylaw or <br /> setting forth such forms andprocedures as it deems desirable and necessary for the <br /> regulation of its affairs and the conduct of its business, including requirements for the <br /> contents and form of applications for certificates, fees hearing procedures and other. <br /> matters. The Commission shall file a copy of any such Rules and Regulations with the <br /> office of the Town Clerk. <br /> The Commission, after a public hearing duly posted and advertised at least 14 days in <br /> advance in a conspicuous place in Town Hall may from time to time amend the design <br /> guidelines which set forth the designs for certain alterations which are, in general, <br /> suitable for the issuance of a Certificate to Alter. 'No such design guidelines shall limit <br /> the right of an applicant for a Certificate to Alter to present other designs to the <br /> Commission for,approval. <br /> The Commission shall at the beginning of each year hold an organizational meeting and <br /> elect a Chairperson, a Vice Chairperson and Secretary, and file notice of such election <br /> with the office of the Town Clerk. The Commission shall keep a permanent record of its <br /> regulations, transactions, decisions and determinations and of the vote of each member <br /> participating therein. The Commission shall undertake educational efforts to explain to <br /> the public and property owners the merits and functions.of an architectural conservation <br /> district. <br /> ALTERATION PROHIBITED WITHOUT A CERTIFICATE <br /> Except as this Bylaw provides, no building or part thereof within a Architectural <br /> Conservation District shall be altered unless the commission shall first have issued a <br /> Certificate to Alter. <br /> ALTERATIONS EXCLUDED FROM COMMISSION REVIEW <br /> It shall be the responsibility of the Commission, or its delegate thereof to determine <br /> whether an alteration is exempt from review. The Commission or its delegate thereof <br /> shall have seven days to make this determination. <br /> The following projects are excluded from Commission review. <br /> • Projects not requiring a building (or demolition)permit. <br /> 0 Structures when not defined as buildings or parts of buildings <br /> • Temporary buildings subject to time limits and size limits by the Architectural <br /> Conservation District Commission. <br /> 9/7/2006 3 <br />
