7 <br /> Board of Selectmen <br /> Minutes <br /> August 7,2017 <br /> APPOINTMENTS & HEARINGS <br /> Public Hearing: Consider a possible modification of entertainment license, Barnstable Pizza&Pasta <br /> Co., Inc., dba Finally Dino's: (continued) <br /> Lee Carvalho of 55 Sassacuss Road stated that he is home every Sunday and does not hear any noise <br /> stemming from Dino's. In the past Mr. Carvalho indicated he has heard the music, but since the <br /> modifications, and with all windows open in the absence of air conditioning,he does not hear additional <br /> noise. <br /> Katherine Judd a resident of 77 Shorewood said she lives down the street from Dino's. Ms. Judd stated <br /> that Mr. Mitrokostas went through great efforts to install sound barriers and she is aware the noise levels <br /> have been metered. Ms. Judd indicated she does not hear the noise from Dino's,but she is able to listen <br /> to the noise from the fair and the Pow Wow. Ms. Judd stated this is summer on the Cape,and if there <br /> was a party at her house, everyone would know. Ms. Judd indicated she has no problem with the music. <br /> Don Weymouth a resident of Seacoast Shores in Falmouth and a certified sound engineer indicated he <br /> conducted measurements recently during an event played by the Baha Brothers connected to the new <br /> internal system. The following measurements were taken on Sunday, July 23, 2017; <br /> 6:12 p.m. 84 db 8' from center <br /> 6:13 p.m. 78 db adjacent to the outdoor bar <br /> 6:14 p.m. 62 db behind the bar <br /> 6:14 p.m. 52 db at the back fence <br /> At 6:15 p.m. the exhaust fan at Dunkin' Donuts started and the db at the fence increased to 63 db <br /> 7:22 p.m. 83 db 8' from center <br /> 7:22 p.m. 74 db adjacent to the outdoor bar <br /> 7:23 p.m. 51 db at the back fence <br /> 9:30 p.m. at the back fence after sunset 61 db from the tree frogs and ambient bug noise <br /> It was noted that rush-hour traffic on Sunday measured 105 decibels. <br /> Jane Maurice of 234 Algonquin Avenue indicated in her back yard she is able to hear the concerts from <br /> the fair as well as the Pow Wow. When her windows are closed and the air conditioning is operative she <br /> does not hear any outside noise. Ms. Maurice stated the Sunday afternoon at the outdoor patio is a day <br /> for all of us to relax and to have fun adding the neighbors dance with a band they like,when they don't <br /> like a band, they complain. <br /> Michael Talbot a resident of 3 Pequot Avenue stated he has done extensive sound monitoring and has <br /> recorded decibel levels over 70 on his back deck. The sound varies, and at times the music is just too <br /> loud. Mr. Talbot indicated that one can give you one circumstance, but we are the neighbors who have <br /> attended the hearings and there is still a problem. Mr. Talbot indicated the bands should face Route 151. <br /> It was noted that this goes on for four nights per week all summer long,and the residents have a right to <br /> use their property. Mr. Talbot in closing stated all we ask is that they be reasonable. <br />
