8 <br /> Board of Selectmen <br /> Minutes <br /> August 7, 2017 <br /> APPOINTMENTS &HEARINGS <br /> Public Hearing,: Consider a possible modification of entertainment license,Barnstable Pizza&Pasta <br /> Co., Inc., dba Finally Dino's: (continued) <br /> In rebuttal Attorney Kevin Kirrane informed the Board that Dino has expended in excess of$20,000 to <br /> address the noise concerns of the neighbors. There has also been a complete change to how <br /> entertainment is provided. This year,the only night other than Labor Day, big bands only play on <br /> Sunday afternoons until 8:30 p.m. After this time,there is no more live entertainment on the exterior <br /> deck. The two large bands,the main subject of the discussion have 6 Sundays and the Monday, and <br /> Saturday night of Labor Day weekend to play. It is essentially 24 hours of entertainment by the two <br /> bands over the course of this year. Attorney Kirrane indicated that last year no one ever said there <br /> would be no sound emanating from the structure. There is background noise from Dunkin' Donuts,the <br /> fair, etc. and we took the steps necessary for the sound emanating from the Dino's building. <br /> On the other nights,the bands are single or duo individuals playing on the deck and the music is over by <br /> 10:00 p.m. This is not an unreasonable situation to deal with explained Mr. Kirrane. <br /> It was disclosed the sound has been monitored by the Town of Mashpee, and it was agreed Dino has <br /> made the necessary changes. However, it appears the two large bands;the Baha Brothers & <br /> Moonlighters are the issue. <br /> Mr. Mitrokostas spoke on behalf of his entertainment license and discussed the history that has evolved <br /> when his business began in 1990 obtaining his first license to operate the pizza establishment. Since that <br /> time the operation has grown since 1996 to a sports bar. Mr. Mitrokostas indicated the establishment <br /> progressed as the population in the Town of Mashpee grew. During his 27 year tenure there has never <br /> been a citation issued. In 1998 the outdoor bar opened. It was a beautiful expansion to better his <br /> operation and to provide a legal and clean business in the Town of Mashpee. Mr. Mitrokostas indicated <br /> he has always maintained an open door policy with the police, and he feels he has gone far to appease <br /> his neighbors. Dino noted that he previously lived in the neighborhood behind his restaurant. <br /> Currently,the Town ordinance for outdoor entertainment on Sundays states 8:00 p.m. Mr. Mitrokostas <br /> indicated he never plays after 8:00 p.m. on Sundays. With other bands,the music stops at 10:00 p.m. as <br /> required. The Baha Brothers and the Moonlighters are large bands, and are noted to be a very popular <br /> entertainment attraction. Mr. Mitrokostas indicated that on this past 4`h of July weekend a complaint <br /> was issued from his neighbors. However,the Pow Wow, illegal fireworks, and motorcycle runs were <br /> also going on, but Mr. Mitrokostas was to blame for the July 4`h issue. It was explained that sound is <br /> difficult to control and fair activities at times overcome the outdoor deck in terms of sound. <br />
