9
Board of Selectmen
Minutes
August 7, 2017
APPOINTMENTS & HEARINGS
Public Hearing: Consider a possible modification of entertainment license, Barnstable Pizza&Pasta
Co. Inc. dba Finally Dino's: (continued)
Mr. Mitrokostas disclosed the Baha Brothers and the Moonlighters are always plugged into his internal
system. Every Sunday, Tony Pizzo his sound engineer is on site to set up the bands.
Mr. Mitrokostas indicated he has invested $35,000 to rectify the situation and is in sympathy with the
neighbors for he has been to their homes. There was no issue with the Baha Brothers on the 23d until
7:44 p.m. During the last song Mr. Mitrokostas noted that he was tapping on the cymbals expressing
appreciation to his patrons for coming to the show. Mr. Mitrokostas added that it is fun entertainment
and during the large Sunday entertainment venues the average age of the patrons is 55 years of age. Mr.
Mitrokostas indicated he is just providing a service that people want.
With respect to the loss of revenue,Mr. Mitrokostas indicated that$17,000 was lost last year in the brief
absence of the entertainment license. Mr. Mitrokostas spoke concern towards his staff members who
had lost a 20%tip ratio, money out of their pockets as many rely on summer employment to help pay for
education. With three more venues to go for the big bands this season, Mr. Mitrokostas stated that he
deserves to finish out the season.
When asked about the performers and use of the internal sound system Mr. Mitrokostas informed the
Board that some of the entertainment venues are too small, and they cannot fit into the system. Singles
or duos usually have one speaker and play a guitar. The system is locked and set and it is difficult to get
to the override situation. In addition some instruments are not miked, such as drums. Mr. Mitrokostas
indicated he has a drum shield, and an extra barrier around the band. This helps to mitigate the drum
situation which is often controlled by the instrument. At the end of the night, with a grand finale, the
noise may emanate. It was noted that all bands face to the blue X,towards the restaurant.
With respect to capacity Mr. Mitrokostas indicated it is monitored frequently outside. It was agreed that
moving the tables, chairs and service was stretched in terms of the outdoor entertainment license. Mr.
Mitrokostas was asked if he set up tables to invite people into the space not defined in the outdoor patio
area. In response Mr. Mitrokostas indicated he is in agreement that he has been pushing the envelope
with respect to this regard, but it is difficult to control people coming and going, standing and sitting,
going to the bar and ordering takeout.
Mr. Mitrokostas was asked if he has been informed that this activity is not allowed by any Town official.
For the record, it was disclosed on July 26,2017, Town Manager Rodney C. Collins became aware of
this situation as it relates to the mandates of occupancy permit, and advised Mr. Mitrokostas this is not
allowed under the terms of his license based on his conversation with Building and the Board of Health,
for septic and in terms of egress in the event of a tragic situation.
