5 <br /> Board of Selectmen <br /> Minutes <br /> December 19, 2016 <br /> COMMUNICATIONS & CORRESPONDENCE <br /> Review of correspondence from the Mashpee Historic District Commission pertainingto o the <br /> waiver of a public hearing requirement: <br /> The Board of Selectmen acknowledged communication from the Mashpee Historic District <br /> Commission dated December 9, 2016 relative to the provisions of Section 7.13.3 of the <br /> Regulations of the Mashpee Historic District Commission soliciting and receiving letters from all <br /> abutters and property owners within 100' of the parcel; 13 Lake Avenue agreeing to a waiver of <br /> the requirement that a public hearing regarding the proposed architectural and site plan changes <br /> to the previously approved Naukabout Beer Company project has been advertised. <br /> There was no action required of the Board of Selectmen for this notification. <br /> NEW BUSINESS <br /> Review and approval of Northbridge Conservation Restriction, Mashpee Commons, LLC: <br /> In accordance with the Development of Regional Impact (DRI) Decision for the Northbridge <br /> Mashpee Assisted Living Facility, the applicant is required to satisfy the open space <br /> requirements by granting a Conservation Restriction (CR) which will permanently protect at <br /> least 7.28 acres of upland having appropriate natural resource values. <br /> The 7.280 acre property is referenced in the proposed CR as Parcels 99-35, 36, 37 Great Neck <br /> Road South, Mashpee which is located in the vicinity of the Children's Museum and adjacent to <br /> the Mashpee Pine Barrens and Mashpee National Wildlife Refuge. <br /> It was disclosed the CR document has been approved by Town Counsel as well as legal counsel <br /> representing Mashpee Commons Limited Partnership. In addition to approval by the Board of <br /> Selectmen, the Mashpee Conservation Commission is also a required signatory. <br /> It was noted the Conservation Commission endorsed the document at their October 9, 2016. <br /> Since this date there have been changes facilitated by Town Counsel to the document to form <br /> only. It is anticipated the Conservation Commission would fully endorse the Conservation <br /> Restriction at their next meeting. <br /> Motion made by Selectman Sherman to approve and execute the Conservation Restriction <br /> between the Town of Mashpee and Mashpee Commons Limited Partnership for the <br /> Northbridge Mashpee Assisted Living Facility as presented, contingent to the approval of <br /> the document by the Conservation Commission of the Town of Mashpee, and subject to <br /> any minor changes that Town Counsel would modify, with no subtenant changes to form. <br /> Motion seconded by Selectman O'Hara. <br /> VOTE: Unanimous. 4-0. <br /> Roll Call Vote: <br /> Selectman Gottlieb, yes Selectman Cahalane, yes Selectman O'Hara, yes <br /> Selectman Sherman, yes Opposed, none <br />
