- 2 <br /> Public hearing was held on the extension of Greeneagle <br /> Drive and b additional lots proposed by New Seabury Corporation.. <br /> Attorney Daniel Rollins appeared at the hearing representing <br /> approximately 12 lot owners of New Seabury. He discussed several <br /> points and in particular stated that in his judgement New Seabury <br /> had never received authorization for cluster zoning and that they <br /> should be made to produce proof of the Board of Appeals finding. <br /> Mr. Burden produced correspondence from the Board of Appeals <br /> indicating approval. However, after inspection by the Town <br /> Counselor he rendered his opinion that it would be neccesary to <br /> see the complete report of the Board of Appeals and that the <br /> burden of producing this report rest with New Seabury Corporation. <br /> The board informed Mr. Burden that we should expect him to produce <br /> this material prior to rendering our opinion of the subdivision. <br /> Mr. Steinhilber appeared before the board representing <br /> Santuit Woods. Mr. Savery informed the board that as Town Engineer <br /> he had inspected the Santuit Woods subdivision and found many items <br /> yet to be completed. He suggested and the board concurred that <br /> Santuit developers provide the Town Engineers with "as built" <br /> profile plans for the entire subdivision. Mr. Steinhilber agreed <br /> to provide these. The board also informed Mr. Steinhilber that the <br /> bond covering the lot construction expires September 30, 1971 <br /> and that all work should be completed by that time including <br /> finishing paving, drainage, slopeing, loaming shoulders, installing <br /> bounds, and proper street signs. Mr. Steinhilber expressed his <br /> opinion that all of this work would be completed by September 30, 1971. <br /> The board also informed Mr. Steinhilber that if they anticipate <br /> any delays they should have the bond extended and proof of the extension <br /> delivered to the board at our next meeting. The board stated <br /> that in no case would an extension be granted beyond November 30, 1971. <br /> Mr. Carl Frank of Mr. Phillip Holmes office presented a preliminary <br /> plan of a proposed road in Mashpee Neck. The proposed road was not <br /> on the applicants land. Therefore, the board suggested that prior <br /> to approval it would be necessary for Mr. Lawrence to produce proof <br /> that he has permission of the land owners over which the lot will <br /> pass. He was also informed that the road would have to be constructed <br /> in accordance with the subdivision requirements (20 feet of 2 1/2 inch <br /> BIT. concrete) . <br />
