Mike advised him that Police and Fire Departments should be alerted about timing in <br /> the event they need to block the roadway. <br /> Tom Fudala asked if they went to DPU to get exempted from local zoning laws. Mr. Bookbinder <br /> responder! "no", that's only if you get treated as a public utility. He said they would not have to go <br /> through zoning. <br /> Tom Fudala said we have a procedural issue. Tom said when Plan Review is issuing your approval <br /> you have to send out notice before the meeting to abutters within 300 feet, which you did not do. <br /> Tom said the only exemption under this Zoning By-Law is "educational" on State property. <br /> Mike Mendoza reminded Tom Fudala that he was part of a meeting to advise the applicant what was <br /> required and this notice to abutters issue was never raised by him at that meeting. A lengthy <br /> discussion followed. <br /> Mike Mendoza asked about the time schedule for this project. Mr. Bookbinder said he is going to <br /> MassDot now to get this done by year-end. <br /> CONCLUSION <br /> Motion: Glen Harrington motioned to continue this Application until October 3, 2017 so that abutters <br /> within 300 feet can be notified.
