MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> SEPTEMBER 27, 2017 <br /> Mr. Kirrane said he addressed the Building Inspector's concerns of a variance by <br /> demonstrating that the two adjacent properties have front setbacks that are less than the <br /> required setback by taking the average of 21.3 ft. which conforms to the 25 ft. average <br /> setback requirement under footnote 6 of the Zoning Bylaws. No variance is required <br /> because you are not varying what the bylaw requires. This is a conforming condition. <br /> Mr. Mendoza had a discussion with the Conservation Agent regarding the 50 ft. buffer that <br /> touches a small part of the addition on the West side. The plan shows the flood zone is AE <br /> further down on the site plan, but on the Town's flood map it was half way through the <br /> house. Mr. Mendoza worked with the GIS Coordinator and found a 2014 letter of map <br /> amendment was made, and the Town has to amend their flood maps to reflect this. He <br /> spoke to the Conservation Agent and recommended a revised comment letter be sent to the <br /> Board to address that issue whether or not it needs to go in front of the Conservation <br /> Commission. Both Conservation comments where read into the record. <br /> Mr. Goldstein made a motion to approve the Written Finding for the house additions. <br /> 1.
