MASHPEE ZONING BOARD OF APPEALS
MEETING MINUTES
SEPTEMBER 27,2017
Mr. Steve Cook, Cotuit Bay Design, represented the homeowners, William. and Doreen
Wade. The property has a foundation on the lot and the homeowners want to move forward
with their house project. They obtained a Written Finding and a Modification from the
ZBA back in 2013. Plans were submitted but they want to make some changes to the house
design and egress platform. Mr. Cook will confirm the revised plans with the homeowners,
because they have been in front of the Board twice in the past. He will provide the Board
with a plan that shows a cross section to verify the height. The foundation is 14-16 inches
off the ground.
The Board had a discussion and determined that the applicant needs to file a formal
modification petition with the ZBA and can be scheduled at the next available hearing. No
vote was required for this informal discussion.
34 Rainbow Lane: Owner,Phil Jackson requests and informal discussion for the Board to
determine if a Special Permit application is required to allow for a bucket truck and dump
truck on property located in an R-3 Zone.
Mr. Phil Jackson, the homeowner was not present and there was no one else representing
him.
Mr. Mendoza told the Board that Mr. Jackson came to the office asked if he was allowed
to have a bucket truck and a dump truck on his property. Mr. Mendoza read the bylaw
Section 17425 Table of Use (I) (2), that states-only one commercial vehicle per lot notto
exceed a 2-ton capacity. Mr. Jackson completed an informal request form for the Board,
but did not provide the tonnage of the vehicle. Mr. Mendoza read the bylaw Section 174-
24 (K) that explains the specific uses and that this would require a Special Permit. The
Board determined this request would require a ZBA application for a Special Permit. No
vote was required because this was an informal discussion and the homeowner was not
present.
Approve September 13 2017 Meetinit Minutes
Mr. Gould made a motion to approve the September 13, 2017 Meeting Minutes.
