Mashpee Zoning Sylvia and Dennis Neighbors <br /> Board of Appeals - v- - 2 <br /> 2 - <br /> NERAL FINDINGS <br /> 1. that the subject property is located at 27 Quaker Run load and contains <br /> 1 <br /> 14.,870 square feet. <br /> VARIANCE CRITERIA <br /> Section 10 of.Chapter 40requires that the permit granting authority determine <br /> 1 <br /> that there are circumstances♦relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner. <br /> r - ' <br /> 'AS CIFIC FINDINGS <br /> _ t <br /> 1. that a literal enforcement ofthe -laves would involve hardship to the <br /> Petitioner. <br /> 2. that relief may be granted without detriment to the public good. <br /> . that relief may be granted without derogating from the intent or purpose of the <br /> By-laves. <br /> . s . <br /> In vie o the foregoing, the Mashpee Zoning Board of Appeals found that the <br /> applicant met the criteria necessary for the granting of a variance. Upon motion duly <br /> made and seconded, the Zoning Board of Appeals voted unanimously on May 2 , 2003 to <br /> grant the following: <br /> 10 foot variance in the front yard <br /> a 6 foot variance in the side yard <br /> a 10.5 foot variance in the rear yard <br /> a 4 foot variance in the rear yard <br /> The decision is �upon compliance with plans from Cape & Islands Engineering, <br /> g <br /> dated April 11, 2003 as prepared for Eric Lubrano for 27 Quaker Run Road, Mashpee, <br /> MA. <br /> ps <br /> g .. <br />
