MASHPEE ZONING BOARD of APPEALS 16 Great Xeck T(oad Xorth <br /> ADUE Decision for a Variance Mashpee, Massachusetts 02649 <br /> R : Paul Hutchinson 25 Cutlass Lane <br /> Map 96 Parcel 87 <br /> V-03-58 <br /> Petition was filed on March 21, 2003 by Paul Hutchinson for a Variance from <br /> 174-31 of the Zoning By-laws to Crary the front setback requirements to allow for <br /> onstru tion of an addition on property located in an R-3 zoning drstrict at 25 Cutlass <br /> Lane (Map 96 Block 7) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication 1n The Mashpee Enterprise, <br /> a newspaper ofg eneral circulation in the Town of Mashpee, on March 28, 2003 and April <br /> 20 , a copy of which is attached hereto and nae a part hereof. <br /> Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, April 9, 2003 at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisionsof Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Pawl Hutchinson represented himself at this hearing. This addition was <br /> approved bythe building department prior'to the zoning change last year, which <br /> instituted -foot setbacks in the front. Mr. Russell wheeler, Building Inspector has <br /> approved this variance due to the time frame of the zoning change. He is requesting a 20- <br /> foot variance on the front yard setbacks. <br /> VARIANCE CRITERIA <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner. <br />
