While the <br /> excavator was tearing down part the structure, it was determined that none of it was <br /> salvageable. Mr. wheeler was called again for a building permit and was denied because <br /> they needed a special permit for the demolition of the entire house. They stopped the <br /> project until this matter could be taken en care of. The building permit has been issued <br /> contingent on the special permit being issued. The Board moves to grant the Special <br /> Permit. No comments from abutters. <br /> GENERAL FINDINGS <br /> 1. that the subject lot is located at 50 Wheeler Road and consists of 44,000 <br /> square feet. <br /> SPECIAL PERMIT CRIT RIA <br /> Code of the Town of llashee § 174-20 states: "Rebuilding of destroyed or <br /> damaged non-conforming in structure. Any cion-conforming building or stracture destroyed <br /> or damaged by fire, flood lightning, wind or otherwise may be rebuilt, subject to approval <br /> of the Board of Appeals subject to the same conditions as set forth in § 174-24 of this <br /> chapter. y <br /> .SPECIFIC FINDINGS <br /> Per § 174-24 of the ZoningBy-laws, the Board determined that the proposed use <br /> r development: <br /> 1. is consistent with applicable state and town regulations, statutes, bylaws and <br /> plans. <br /> 2. will not adversely affect public health or safety. <br />
