Lipnosl y 3 5 Notre Dame Lane <br /> Lipnosl y Family Trust Map 3 Parcel 89 <br /> V—03- 9 <br /> A Petition was filed on April 23, 2003 by Lipnos y Family Trust for a variance <br /> under Section 174-2 lie Zoning Bir-laws for permission to seek relief from the <br /> growth control requirement for lot number 5 in the subdivision plan noted as the last lot <br /> in the subdivision to obtain a building permit on property located in an R-5 zoning <br /> district at 35 Notre Dame Lane Map 3 Parcel 9 Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> newspaper of general circulation in the Town of Mashpee, on May 2, 2003 and May 9, <br /> 2003, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town lull on <br /> Wednesday, May 28, 2003, at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: Zell .Bli enberry, Richard Guerrera, and <br /> Robert Nelson. Edward Govoni stepped down and left the room. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Attorney Kevin I irrane represents the petitioner. Applicant has developed a <br /> subdivision whereby 6 parcels were developed as buildable lots. flue to the growth <br /> zoning by-law he is unable to obtain a building permit on the last parcel of land in this <br /> subdivision. Applicant is seeping relief from the growth control requirement to obtain a <br /> building permit. Building Inspector Russell wheeler has indicated that he has not come <br /> close to issuing the 70 building permits which is the maximurn number he can issue in <br /> one calendar year. Attorney Rirra.ne feels there is no.detriment to the community to issue <br /> this variance. The Board moves to grant the variance. <br />
