I <br /> Board oI Selectmen <br /> Minutes <br /> January 6, 200 <br /> APPOINTMENTS ANIS HEARINGS. <br /> I � <br /> VFW Post 5489—Hearin <br /> Selectman Leveille stepped down for the above referenced Hearing. <br /> Selectman Taylor opened the hearing on the reported VFW liquor license <br /> violation on Friday, December 13, 2002. The Mashpee Board of <br /> Selectmen, acting as the licensing authority for the Town of Mashpee have <br /> granted the VFW the opportunity to show cause as to why the All Alcohol <br /> Club License and/or Entertainment License of the Mashpee Veterans o <br /> Foreign war, Inc., d/b/a Mashpee Memorial VFW Post 5489, should be <br /> modified, suspended, revoked or cancelled. <br /> Complaints were received on the violation date of December 13, 2002 <br /> relative to a teem event Meld at the VFW. A noise'complaint was reported. <br /> Patrons were noted to be on the subject premise.until -:00 a.m. The <br /> license as stipulated for both liquor and entertainment is valid until 11:0 � <br /> p.m. for only VFW members and them guests. <br /> Correspondence was received from VFW Post President{Ted Theis dated <br /> January 3, 2003 with respect to this regard. Mr. Theis was unable to <br /> attend the Hearing due to a previous commitment. He detailed the VFW' <br /> mission to service the community, and indicated in his letter that steps <br /> have been taken to preclude the possibility of reoccurrence. <br /> Jesse Barry, Commander was present on behalf of the MashpeeVeteran's <br /> of Foreign wars to discuss this ratter with the Board of Selectmen and <br /> interested public. Alice gibbons, Manager was in attendance. <br /> Mr. Barry apologised for the recent.incident on behalf of the VFW and <br /> assured the Selectmen that this would not happen again. Mr. Barry <br /> indicated that his organization is obligated to perform certain community <br /> services and if the Selectmen were to deny the liquor license, it would <br /> severely impair their duties. <br /> It was noted that the VFW is scheduled to conduct their next board <br /> meeting on Tuesday, January 14, 2003. The matter would be respectfully <br /> addressed by the full VFW board at this tire. <br /> s <br />
