7 <br /> Board of Selectmen <br /> Minutes <br /> June 6,2016 <br /> APPOINTMENTS &HEARINGS <br /> Public Hearing: Private to Public Road Conv rsion of Leeward LM: <br /> The Board of Selectmen opened the Public Hearing on the private to public road conversion of <br /> Leeward Lane. In accordance with posting requirements,the Hearing notice was read aloud into the <br /> record. <br /> Catherine Laurent,Director of Public Works indicated that Leeward Lane is a single road,and it is <br /> deemed a complete reconstruction project. The Town will be installing additional drainage in addition <br /> to the drainage repairs planned to correct a large pot hole. This is an incremental cost attributed to the <br /> failed drainage. The total betterment assessment estimate is$104,166.30. The maximum charge to be <br /> assessed by the Town of Mashpee for this betterment by each of the 9 property owners is $11,574.03. <br /> Donna Erdman 33 Leeward Lane asked about the payment process. It was disclosed the betterment <br /> would be to be contained on the quarterly real estate tax bill. There is an option to pay the betterment <br /> in full or to make quarterly payments over a twenty year time period. It was reported the timeframe for <br /> submission of the second petition is July 11''for the October 2016 Town Meeting. If the project is <br /> approved by a vote of Town Meeting,work is anticipated to commence the following spring. <br /> Gena Hotton, 25 Leeward Lane noted there is 14 Leeward Lane address for someone's driveway. Ms. <br /> Laurent indicated the referenced property has been included in the betterment assessment. It was <br /> disclosed that all residents pay an equal share. Ms. Hotton stated the condition of the large pothole is <br /> dramatic. She asked if the repair would have to wait until Town Meeting approval. Ms. Laurent <br /> indicated after a successful town meeting and vote of approval,the town would conduct an immediate <br /> temporary repair. Full construction would commence in the spring if the petition is received before the <br /> deadline for the October Town Meeting. <br /> Paul Perry,41 Leeward Lane reaffirmed the pothole may be a crater by October. Mr. Perry indicated <br /> the pothole has been enlarging since 1992. Mr. Perry stated the puddle is quite deep and most of it is <br /> situated on Cotuit Road. The DPW Director indicated the Town has added additional drainage to the <br /> project as the road is not sufficient to handle the capacity of the storm water. It was stated the source <br /> of the water is Leeward Lane. In the process, a second hearing is held, and the Board of Selectmen <br /> reviews the final betterment. This estimate is the maximum cost to be borne by each property owner. <br /> Gena Hotton asked why the pothole cannot be fixed now. In response Ms. Laurent indicated the Town <br /> has a limit on the amount of repairs. Typically one emergency repair is conducted and neighborhoods <br /> are encouraged to petition the Town for a road conversion. To conduct an immediate repair it would <br /> be necessary to obtain authorization from the Board of Selectmen or Town Manager, <br /> It was agreed if the petitioners succeed in getting the required signatures on or before the deadline in <br /> July for the October Meeting the residents would be allowed to meet with the Board of Selectmen to <br /> review the possibility of temporary repairs that may be appropriate. <br />
