He explained the proposed <br /> project is the removal of the deck in the southeast corner and the middle deck is to be <br /> expanded and most of it will be within 50' of the marsh edge and a new set of steps will <br /> be constructed. He noted one corner of the deck will have to be removed per the Board <br /> of Appeals decision. The steps will be about 3 feet closer to the edge of the marsh. He <br /> noted the proposed mitigation planting area as shown on the plan provided. <br /> The Agent noted the mitigation areas on the photos and recommended a Close and <br /> Issue. <br /> No comment from the public <br /> Motion: Mr. Smith moved to Close and Issue, seconded by Mr. Shaw. Vote <br /> unanimous 6-0 <br /> The Agent noted that a tree fell in the river on the downstream side of the John's Pond <br /> fish ladder. AmeriCorps is going to dismantle the tree and take it out of the river <br /> channel. <br /> The Agent informed the Commissioners that the project at 29 Overlook Drive in <br /> Popponesset Village that the abutters have appealed to DEP. DEP has scheduled an <br /> onsite meeting at the property. Following the meeting, DEP will issue a superseding <br /> Order of Conditions either to uphold the Commissioners' decision to approve the project, <br /> which was a tear down/rebuild of a single family home, implement a Superseding Order <br /> of Conditions (which may require some additional changes to the project) or denial of the <br /> project if in their opinion it didn't meet the performance standards. He said any of the <br /> Commissioners can attend the meeting which will be held on November 2 at 10:30 a.m. <br /> at the site. <br /> 5 <br /> 5 <br />
