MASHPEE ZONING BOARD OF APPEALS <br />MEETING MINUTES <br />APRIL 12, 2017 <br />166 Wheeler Road: Owners, Stephen and Donna Barber request a Variance from the front <br />yard setback under §174-31 (Land Space Requirements) of the Zoning Bylaws to allow for <br />construction of a detached two car garage on property located in an R-5 Zoning District, <br />Map 49 Parcel 9, Mashpee, MA. <br />Mr. Collins O'Connor represented the homeowners for this project. Mr. O'Connor said the <br />Board approved a sideline variance back last November for the garage. He said it was <br />staked out and ready for excavation when the homeowners noticed the design was closer <br />to the house than they wanted, and therefore would like to move it 8 ft. closer toward the <br />street. Mr. O'Connor does not feel that it changes the character in the neighborhood. <br />Mr. Bonvie wanted to know what the distance is between the house and the proposed <br />garage. Mr. Bonvie thought this was a self-imposed variance. <br />Mr. O'Connor said it will be about 18 ft., and the previous design was 10 ft. and taking <br />away the view from the kitchen. <br />The Board had a conversation with the applicant suggesting he could take an average <br />setback from the street with other properties in the neighborhood. They reviewed the <br />previous approved plot plan and compared it with the current plan and determined there <br />was a hardship with the odd shaped typography of the lot. <br />Mr. Bonvie read Conservation Comments and Board of Health comments into the record. <br />Mr. Furbush read the Inspection Department comments into the record. <br />Mr. Bonvie made a motion to issue an 8 ft. Variance for the front yard setback, and the <br />hardship due to the typography of the lot. Referencing a prior issued 3 ft. side yard variance <br />which will remain in existence with this issued variance. Also conditioning all department <br />comments read into the record.
