MASHPEE ZONING BOARD OF APPEALS <br />MEETING MINUTES <br />APRIL 12, 2017 <br />10 Waterline Drive North: Owners, Edward and Sally Kazarian request a Written Finding <br />under §174-17 (Nonconforming buildings and uses) and §174-33 (Setback from water and <br />wetlands) to allow for an addition on property located in an R-3 Zoning District, Map 120 <br />Parcel 174, Mashpee, MA. <br />Mr. Tom Bunker, of BSS Design represented the applicants for this project. Mr. Bunker <br />said it's a non -conforming structure. The rear setback is 12. 9 ft. instead of 15 ft., and the <br />set back from the wetlands is 36 ft. instead of 50 ft. The proposed work is in the front of <br />the house. It's a small addition that consists of 16 sq. ft. The floor plan shows that the <br />project is to square off the kitchen and take a part of the existing porch. The street view <br />shows they are adding 3 ft. 9 inch wide with a one story. This is keeping with the character <br />of the neighborhood and is well within the lot coverage standards. <br />The Board had a conversation regarding the bylaw regarding pre-existing, non -conforming <br />conditions. <br />Mr. Goldstein read the Conservation Department and Board of Health comments into the <br />record. Conditioned upon all department <br />comments read into the record. <br />Mr. Blaisdell seconded yes, Mr. Furbush yes, Mr. Goldstein yes, and Mr. Gould yes. All <br />were in favor of the Written Finding of the proposed addition. <br />61 Pleasant Park Drive: Southworth Cape Development, LLC, requests a Variance under <br />§174-31 (Land Space Requirements) of the Zoning Bylaws to deem lot buildable on <br />property located in an R-3 Zoning District, Map 70 Parcel 162, Mashpee, MA. <br />Attorney Kevin Kirrane represented the application for the variance request. Mr. Kirrane <br />provided a copy of the subdivision plot plan that was approved in 1984. The zoning criteria <br />was 20,000 sq. ft., and since then zoning criteria has changed to 40,000 sq. ft. Back in 2013 <br />the Zoning Board granted this variance for this particular lot, and at that time Southworth <br />Development thought they had a buyer that was prepared to purchase but it did not happen. <br />5 <br />
