Chairman, Jonathan D. Furbush, Board Members William A. Blaisdell, Ronald
Bonvie, Dom DeBarros, Scott Goldstein, and Associate Member, Norman J. Gould were
present.
PLEDGE OF ALLEGIANCE
CONTINUED HEARINGS
41 Greenwood Road: Owner, Ellen J. Harris requests a Variance to allow for a shed to
be placed less than one foot from the rear and side yard setback under §174-31 of the
Zoning Bylaws on property located in an R-3 Zoning District, and Popponesset Overlay
District, Map 117 Parcel 312, Mashpee, MA. (Continued from April 26, 2017 at the
request of the applicant).
Ellen Harris represented herself for the variance request. She said she originally requested
the shed to be placed in the back corner of the property between Lot 3, Lot 7, and Lot 8.
She said the Lewis' (Lot 7), requested that the shed be 5 ft. from her property. The
Wagner's (Lot 8), and her brother (Lot 3) have no issues where the shed is placed. She said
the Wagner's do not mind that the shed is placed directly behind their shed (Lot 8), which
would be 1 ft. from the property line.
Chairman Furbush asked how she would do maintenance on the shed, or if the Wagner's
sold their house. The new neighbor may not approve of the shed's location. That is why
there is a 5 ft. setback requirement, and it used to be 15 ft.
Mr. Bonvie said if a new neighbor put up a fence then there would only be a 1 foot distance
between the shed and fence. He asked Ms. Harris what the shed dimensions were.
The Board had a discussion with the applicant regarding the dimensions of the shed and
where the best possible location for the shed to meet the Board's approval.
Chairman Furbush suggested that the applicants continue their hearing and return with a
revised site plan showing an appropriate location for the shed with the correct dimensions
depicted on the revised plan. The Board told the applicants that they cannot make a decision
until they have a definitive location of the shed depicted on a revised site plan.
Mr. Bonvie made a motion to accept the request for continuance from Ellen Harris of 41
Greenwood Road, until Wednesday, May 24, 2017 hearings. Mr. Goldstein seconded, yes.
Mr. Blaisdell, yes, Mr. Furbush, yes, Mr. DeBarros, yes. All were in favor to continue the
hearing until May 24, 2017.
1
