MASHPEE ZONING BOARD OF APPEALS
MEETING MINUTES
JULY 12, 2017
Conditioned on all Town department comments read into the record to become part
of the Special Permit.
6. Conditioned that the Special Permit be specifically referenced and become part of
the condominium documents including the Town department comments.
7. Conditioned that the Special Permit will specifically be referenced in the
condominium documents at the time of submittal for a building permit.
8. Prior to the request of an occupancy permit by the applicant, the applicant will
prove to the Zoning Enforcement Officer that the prior mentioned condominium
documents have been recorded at the registry of deeds.
9. Contingent upon final approval by the Board of Health and their stipulations that
were read into the record, and that their comments are included as an Attachment
to the Special Permit Decision.
10. Conditioned that the condominium draft documents are referenced as Exhibits to
the Special Permit Decision.
Mr. Goldstein seconded, yes. Mr. Blaisdell yes, Mr. hurbush yes, Mr. DeBarros yes. All
were in favor of the boat storage facility.
The Board had a discussion about having a member of the Zoning Board to be included on
the Plan Review Committee for future applications. Mike Mendoza said he would have a
conversation with the members and discuss this request.
OTHER BUSINESS
-6 Kanter Lane —Board to determine if second floor addition is a substantial change and
requires an application for a minor modification.
Mr. David Liimatainen, owner of Eagle's Nest Builders, LLC represented the application
and is currently working on the project at 6 Kanter Lane. He said there is an existing second
floor addition that already exists, and is supported by three columns and sono tubes. The
proposal is to enclose around the sono tubes, and will not increase the foot print or expand
it. The project was approved back in 1995. He spoke to the Conservation Agent and he has
no problem enclosing the space.
Mr. Furbush read the Conservation Department comments into the record that were
received on July 12, 2017.
The Board had a conversation about the original application back in 1995 and wanted to
make sure that the abutters were notified. The Board does not believe it is a zoning issue
but simply a building issue because he is not building beyond the existing structure.
10
