MASHPEE ZONING BOARD OF APPEALS <br />MEETING MINUTES <br />AUGUST 23, 2017 <br />Mr. Kevin Kieler, Permit Solutions represented the homeowner, Michael Cusack who was also <br />present. Mr. Kieler said that the house was in need of renovations and the homeowner would like <br />to put an addition on, and also reconfigure the interior of the existing home. Mr. Cusack had <br />purchased the lot next to his property and merged both lots together to accommodate his proposed <br />renovations. <br />Mr. Kieler said the distance from the front lot line to the existing deck is currently 28.72 ft. The <br />first variance request would be to allow the increase the square footage of the proposed front deck <br />up to the stairs which will become a foot larger, but will not be going any closer to the front lot <br />line. The second variance request is the proposed rear deck which will be moving closer to the side <br />lot line to accommodate the stairway and is designed due to the unusual slope of the property. <br />Mr. Kieler said that the Planning Board approved the merging of the two lots which increased the <br />square footage to 25,442 sq. ft. and the distance from the front to 143.25 ft. The design of the <br />addition is "L" shaped, and the additional deck is squared off in the rear to minimize the <br />encroachment into the 50 ft. buffer from the wetlands. He provided the Board with photographs of <br />the existing lot as well as the adjacent homes and letters from the abutters that support the proposed <br />project. <br />Chairman Furbush asked the applicant if he had the average front setbacks of the adjacent lots. <br />The Board had a conversation regarding grandfathered lots, and the uniqueness of this project as it <br />pertains to the difference between a pre-existing non -conforming condition and a variance situation. <br />The Board told the applicant that there are some issues with the plot plan. Mr. Bonvie would like _... <br />to see the average setbacks for the front lot line from the adjacent properties. <br />Mr. Goldstein said he does not see a hardship if increasing the front deck and believes it's a decent <br />size already. He also doesn't see a hardship on the proposed rear deck that shows the increased <br />distance from 1599 ft. to 10.34 ft. He made a couple of suggestions to the applicant either to slide <br />the stairs back and just have a landing on that corner which will still be 10.34 ft. or move the deck <br />to the rear and have the stairs go down toward the right side and still create a means of egress from <br />the front, and that will make it less non -conforming. Also the plan does not show the existing deck <br />in the rear. <br />The Board didn't have any other issues and told the applicant they would like to see two revised <br />plot plans, an existing and a proposed. <br />Mr. Kieler formally asked for an extension until September 13, 2017 hearings. <br />Mr. Bonvie made a motion to accept the applicant's formal request for an extension for the Written <br />Finding and the Variance until September 13, 2017.
