MASHPEE ZONING BOARD OF APPEALS <br />MEETING MINUTES <br />DECEMBER 14, 2016 <br />Mr. Bonvie made a motion the Board finds that the reduction from 29.5 of the front yard <br />setback is now 28.5 feet, and is considered a minor modification and is approved as such. <br />Mr. Blaisdell seconded, yes. All were in favor. The Board allowed the change for the front <br />setback and considered it a minor modification without the need to go through a formal <br />hearings process. <br />419 Monomoscoy Road: Owner, Walter S. Wightman requests a Written Finding under <br />§ 174-17 of the Zoning Bylaws to raze and replace a single-family dwelling on property <br />located in an R-3 Zoning District, Map 124 Parcel 68, Mashpec, MA. (Owner is requesting <br />a withdrawal). <br />419 Monomoscoy Road: Owner, Walter S. Wightman requests a Variance from the side <br />yard setback under §174-31 of the Zoning Bylaws to raze and replace a single-family <br />dwelling on property located in an R-3 Zoning District, Map 124 Parcel 68, Mashpee, MA. <br />(Owner is requesting a withdrawal). <br />Mr. Blaisdell read a letter dated December 2, 2016 submitted by the applicants requesting <br />a withdrawal without prejudice. <br />Mr. Bonvie made a motion that the Board accept the request for withdrawal of the Written <br />Finding application. Mr. DeBarros seconded, yes. All were in favor to accept the <br />withdrawal of the application for the raze and replace project. Mr. Bonvie made a motion <br />to accept the withdrawal of the Variance application. Mr. Gould seconded, yes. All were <br />in favor. <br />3 Bluff Avenue: Owners, John J. and Kelly C. Spinard request a Written Finding under <br />§ 174-17 of the Zoning Bylaws to allow for extensions and alterations of a pre-existing non- <br />conforming, single-family dwelling on property located in an R-3 Zoning District, and <br />Popponesset Overlay District, Map 112 Parcel 94, Mashpee, MA. <br />Mr. Blaisdell announced that Brad would be sitting in on this hearing. <br />Attorney Mark Gildea represented the homeowner, Mr. Spinard who was also present. He <br />said that the lot is approximately 7,123 sq. ft. He said the Spinard's have owned the <br />property for 16 years and the accessor's card shows that the structure was built in 1925 <br />which pre -dates zoning. The application is for a Finding under section 174-17. <br />Mr. Gildea mentioned that he read the Inspection Department comments and explained the <br />proposed changes and alterations to the Board. He said there's an existing sunroom in the <br />back of the property situated on Bluff Ave. That sunroom is going to be changed into a <br />kitchen and is depicted on the house plans. The non -conformity with respect to that part of <br />the structure, is the setback to the lot line. He said the setback is not changing, there's no <br />more non -conformity based upon the proposal. The second change would be in front of the <br />property where there is an existing deck that will be enclosed at the entrance of the house. <br />91 <br />
