Mike Szarlan, of Clipper Landscape, was present <br />regarding the request and provided the following estimates: top coat paving -$6,000 + 2,400 <br />labor; three property bounds -$450; loam and seed $500 = $9,350. Mr. Szarlan provided the <br />estimates to Mr. Fudala. <br />MOTION: Mr. Balzarini made a motion not to add 50% as a security and that $9,350 will <br />be accepted as the total amount of security. Mr. Cummings seconded the motion. All <br />voted unanimously. <br />MOTION: Mr. Balzarini made a motion to release the covenant in exchange for the <br />security of $9,350. Mr. Cummings seconded the motion. All voted unanimously. <br />Planning Board members signed the Release. Mr. Rowley requested that he be contacted for a <br />final inspection once the work was completed so that he could report to the Planning Board and <br />the security could be released back to the project proponent. <br />DEFINITIVE SUBDIVISION PLAN <br />Status of construction schedule for BCDM / Ockway Highlands road work <br />The Chair read for the record the 10117 letter submitted by Matt Haney of BCDM. In his letter, <br />Mr. Haney stated that he had updated the construction schedule based on the 1013 site meeting <br />and agreed to schedule a follow up site meeting once tree stumps had been removed. Mr. <br />Rowley stated that he, Mr. Balzarini and Mr. Hansen had met on site with Mr. Haney on October <br />10, Mr. Rowley confirmed that there had been no erosion issue beyond the stump removal <br />because the graded area was relatively flat. Mr. Rowley recommended that, upon removal of the <br />stumps, the area be re -inspected in case soil was disturbed and erosion control needed to protect <br />the neighbors. Mr. Rowley discussed the need to acquire a Road Opening permit from DPW <br />with Mr. Haney, strongly requesting that it be acquired during that week. In discussion with <br />Catherine Laurent, Mr. Rowley confirmed that Mr. Haney had not requested the Permit and Mr. <br />Fudala confirmed that it had not been requested as of today. Mr. Fudala added that Mr. Haney <br />told him that Ms. Laurent would not accept an application from anyone other than Robert Our <br />for paving. Mr. Rowley referenced use of Carriage Drive, the connector between Blue Castle <br />and Degrasse Road for construction vehicles, adding that he advised Mr. Haney to install stone <br />for a temporary entrance to protect Degrasse. <br />Mr. Rowley visited the site again tonight, due to neighbor reports that additional trees had been <br />cut down. Mr. Fudala stated that Mr. Haney indicated that the additional trees were removed to <br />install water lines on his lots on the south side. Mr. Fudala received a series of calls about <br />equipment entering onto Blue Castle Drive, being in the middle of the road, blocking the road. <br />Mr, Haney's response was that the neighbors were complaining about everything. The Chair <br />inquired whether anyone had contacted the Police since the road was blocked. Ms. Laurent <br />planned to contact the Police about a Cease and Desist Order, but the crew had departed before <br />the end of the day. Mr. Rowley reported that trees had been cut down on both sides of Blue <br />Castle. When Mr. Rowley inquired about his schedule at their site meeting, Mr. Haney <br />confirmed that he would be removing only the stumps by the end of the month and nothing else <br />0 <br />
