Glen Harrington stated that an Emergency Condemnation had taken place at 7 Lakeside Estates. The trailer is
an abandoned unit, the windows are missing, and the trailer is open to the elements. Mr. Harrington has a bill
of sale indicating that the Haney's own the trailer. The neighbors are continually complaining, and the Health
Department is re-evaluating this situation. The Board of Health is to consider this as a nuisance, so that an
order can be issued to raze and remove the unit. Also, the rodent problem has not been addressed.
Kalliope Egloff made a motion that the Board of Health consider 7 Lakeside Estates, 300 Nathan Ellis
Highway, a nuisance according to MGL 111 Section 122. Burton Kaplan seconded the motion. The motion was
unanimously approved.
Mr. Harrington commented that Town Counsel recommended a daily fine be assessed if the owners fail to
demolish and remove the unit within the specified time frame.
Kalliope Egloff made a motion that the Board of Health amend the previous motion to include that failure to
remove the dwelling at 7 Lakeside Estates, 7 days from receipt of the notification of the nuisance, would result
in a fine of $50 per day. Burton Kaplan seconded the motion. The motion was unanimously approved.
ADDITIONAL TOPICS
None.
DISCUSSION
1. Meeting Update — Mashpee Cares Committee Meeting: Lucy Burton.
Burton Kaplan remarked that Lucy Burton was not available to discuss the Mashpee Cares Committee Meeting
but will update the Board at the next Board of Health meeting scheduled on May 21, 2015.
2. Meeting Update — Waste Management Committee Meeting: Kalliope Egloff.
Kalliope Egloff stated that the Waste Management Committee was reprimanded via email by the Mashpee
Town Manager, Joyce Mason, for acting inappropriately towards the Department of Public Works Director,
Catherine Laurent. The last meeting was cancelled and had not been rescheduled. Ms. Egloff expressed her
feeling that the Committee may not be in existence much longer. Joyce Mason may make a recommendation
to the Selectmen to dissolve the Waste Management Committee.
3. Coalition for Responsible Retailing.
Glen Harrington stated that the Coalition for Responsible Retailing sent all Boards of Health a letter explaining
how to revise the tobacco regulations so the youth cannot access tobacco products. The Mashpee Board of
Health had revised their tobacco regulation preventing minors from obtaining tobacco products. All e -cigarettes
are included in the tobacco product regulation. Minors cannot purchase tobacco products until they reach legal
age, parents are not allowed to give minors tobacco products, and fines will be issued to underage offenders.
NEXT MEETING
The next meeting of the Board of Health is scheduled for Thursday, May 21, 2015, at 7.00 PM. As there was
no further business, Kalliope Egloff made a motion to adjourn the Public Session Meeting of the Board of
Health at 7:57 PM. Burton Kaplan seconded the motion. The motion was unanimously approved.
Respectfully submitted,
Frances Boulos
Administrative Assistant
Mashpee Board of Health
attachments
