Executive Session <br />Motion: Dino Mitrokostas moved to go into executive session to discuss strategy <br />with respect to litigation between EDIC, Mr. Sugg and Mr. Vaccaro as an open <br />meeting may have a detrimental effect on the bargaining or litigating position of this <br />public body and the Chair so declares. Seconded by Terrie Cook. Roil Call Vote: <br />Carol Sherman, yes; Dino Mitrokostas, yes; Robyn Simmons, yes; Terrie Cook, yes. <br />Unanimous 4-0 <br />Tom Mayo noted there has been difficulty with communication between Mr. Bugg and <br />his attorney. After a lot of communication between Tom Mayo and Pat Costello, <br />Attorney Gildea got in touch with Mr. Bugg. The scheduled hearing date for the courts to <br />decide the deposit in the escrow account is April 28 which is a result of the initial filing <br />by Mr. Vaccaro. Tom reminded the members that at their last meeting, the members <br />authorized Town Counsel to release Mr.Vaccaro and to open negotiations for a <br />settlement. Town Counsel received a comment back from Mr. Gildea that Mr. Bugg <br />wants to split the escrow account with EDIC. EDIC's previous motion was to clear <br />$10,000 after attorney fees. Pat Costello would like to counter with the split offer so he <br />is looking for the members to authorize him to negotiate a 50-50 split_ <br />Motion: Terrie Cook moved to support the suggestion of town counsel, Pat Costello, <br />to split the escrow down the middle, seconded by Robyn Simmons. Vote unanimous <br />5-0. <br />Motion: Dino Mitrokostas moved to come out of executive session, seconded by <br />Robyn Simmons.
